Prosecutors of the Prosecutor’s Office attached to the Bucharest Court of Appeal proposed a suspended sentence for a lawyer who caused a accident auto without casualty after he got behind the wheel with a blood alcohol level of 2.65 g/l of pure alcohol in his blood, after he had also consumed cannabis. Signing a plea deal turned the sentence of one year and six months in prison into 2 years of supervision.
During the investigation, the lawyer admitted his actions, and prosecutors agreed to enter into a plea agreement with him, which provides for the application of a suspended sentence.
“On 20.05.2026, the case prosecutor from the Prosecutor’s Office attached to the Bucharest Court of Appeal concluded, under the conditions of art. 478 et seq. of the Code of Criminal Procedure, a plea agreement with a defendant – a natural person, having the capacity of a lawyer at the Bucharest Bar, being given the main penalty of one year and six months in prison, suspended under supervision, for a term of two years, in consideration committing a crime of driving a vehicle under the influence of alcohol or other substances”, the Prosecutor’s Office reported on Monday, May 25.
At the same time, the court also decided on a complementary punishment, for a period of one year, from the date of the definitive stay of the decision, consisting in the prohibition of the exercise of the right to be elected in public authorities or in any other public positions, the right to occupy a position that involves the exercise of state authority and the right to drive vehicles on public roads, for which the law stipulates the mandatory possession of a driving license, the prosecutors say.
“Also, the defendant was forbidden, as an accessory punishment, for the duration and under the conditions provided for in art. 65 paragraph 3 of the Criminal Code, to exercise the same rights mentioned above, in accordance with the provisions of art. 65 paragraph 1 and art. 66 paragraph 1, letters a), b) and i) of the Criminal Code,” the Prosecutor’s Office attached to the Bucharest Court of Appeal also submits.
The prosecutors explain that the said lawyer was involved in a car accident in September 2025, and the expertise carried out at INML showed that he had consumed alcohol and CANNABIS.
“When concluding the agreement, the fact that on 01.09.2025, around 2:35 a.m., the defendant drove, within the Bucharest city limits, a vehicle for which the law requires the possession of a driver’s license, while under the influence of psychoactive substances (respectively, following the consumption of cannabis) was impaired, his ability to drive vehicles was taken into account public roads, as it results from the contents of the forensic report drawn up, in the case, by INML “Mina Minovici”, as well as having an alcohol concentration in the blood higher than the limit of 0.80 g/l of pure blood alcohol, above which such an act constitutes a crime, respectively 2.65 g/l of pure blood alcohol, according to the forensic report drawn up by INML “Mina Minovici”, the occasion with which he was involved in a road accident resulting in material damage”, says the Prosecutor’s Office.
The agreement concluded between the two parties was sent for approval to the Bucharest Court of Appeal.
