In the court session against the mayor of Tirana Erion Veliaj, lawyer Plarent Ndreca presented five preliminary requests, which according to him would put the process on “legal tracks”.
The defense asked for the live broadcast of the session, the presence of Veliaj next to the lawyer, that is, outside the glass cage, as well as time to get to know the evidence. Ndreca also said that SPAK has not yet responded to the administration of the reports of Nesti Angoni and Nasta Pëllumbi.
Plarent Ndreca: We have made 5 requests to put the process on the legal track, we insist. The first thing that belongs to the judicial publicity is that you bring out the cameras as soon as we start. There is no constitutional obstacle to not broadcasting the hearing. The fact that an administrative employee comes to the hall and asks us when we agree and who does not agree to filming, is direct interference in the hall. Not allowing the filming of this process is a violation of the constitutional right of the media. I ask that cameras be allowed to film the process live.
We believe that the presence of Veliaj should be guaranteed free outside the glass cage. Not being present or not being allowed near the lawyer violates the presumption of innocence, human dignity, affects the process and cannot continue without being present as the constitution provides. The Helsinki Committee considers it a violation of human dignity when there is no reason to assess the opposite. The glass cage is back in order while it should be the exception. It does not pose any risk to the smooth running of the process. I ask you to guarantee that he will be with his free lawyer, to defend himself as the constitution has guaranteed him.
As long as we are not familiar with the evidence at this stage and you said it is not an obstacle at this stage, give us time to familiarize ourselves with it.
We have not yet received an answer from SPAK regarding the administration of the reports of Nesti Angoni and Nasta Pëllumbi. We estimate that it is related to this stage of the process
Leaving the session once a week on your part is a very tight deadline that does not give us the opportunity to communicate with our clients. To have real presence and effective protection.
These are our 5 requests that I believe their acceptance would put this legal process on track, we definitely also have requests for invalidity of acts.
