Vetting/ Court against the Prosecution for the case of the Boçi family in Lushnje, a full investigation of the file is required

In 2017, the Prosecutor’s Office of Lushnje with the prosecutor of the case Skënder Mestani would start the investigations on the case of the Boçi family. Bukuria and Dhimo would report abuse of office, but also for falsification of documents, and these two reports would be combined under a single investigation. Only that in this case we would have a clash between the Prosecutor’s Office and the Court of Lushnje, where the latter would ask the Prosecutor’s Office in both cases to conduct in-depth investigations.

Former prosecutor Mestani would request the dismissal of the case, but the Court of Lushnje would request the reopening of the investigations since they had not been completed in a complete way, while paradoxically the Prosecutor’s Office claimed that we might be under the terms of the statute of limitations.

On the other hand, the Prosecutor’s Office had not carried out complete verifications and investigations to ensure these conclusions. The same would be done by the Vlora Appeals Prosecutor’s Office, which would request the dismissal of the case, but the case would be returned to Lushnje to carry out full investigations since there were actions that have not been verified.

“We asked for the criminal report, Vasillaq Ziu took the criminal report, but we didn’t know, let’s go, we are filing a criminal report. What did Vasillaq Ziu do?

He did not receive a criminal complaint, but he did receive a statement. When did we learn this?! We learned this because we said why the Prosecutor’s Office is not calling us for this sensational event that we were raped. We went there, the prosecutor was Artan Azbiu. We told him we have a property, we went to Bubullimë… will there be a trial for this matter? He told us, you have no criminal record. What do we have? You have a statement and there is no report for you”, says Bukuria disappointed.

Bukuria claims that the case has dragged on and it has not been established anywhere that she and her husband were raped, accusing them of interference by the State Police to their detriment. An interesting element emerges from the Prosecutor’s Office file, where all the people questioned, starting with the bailiffs and the people near the former ALUIZNI and the former Property Registration Office, claim that they did not know that the property was registered in the name of the Boçi family.

“There, the husband’s prosthesis was broken and there were injuries to his chest and we did not take these things into account because Vasillaq Ziu called him on the phone the day before, that we said “today we are not going because we are not in a position to go because we were raped”, but the next day we went to the coroner and after that we talked to the prosecutor. He made an x-ray and the x-ray showed that there was a collapse in the chest. He did not tell us, this was the coroner’s duty to check my husband”, said Bukuria, proving that their violence was buried by the institutions.

From the investigations of former prosecutor Skënder Mestani, it appears that specialists and those in charge at the National Inspectorate of Territory Protection were interrogated about the reasons why the Enforcement and Inspectorate of Territory Protection in Lushnje Municipality was not supported with machinery.

But the failure on the ground was no accident. The documents reveal that behind every defect of the stadium was hidden a chain of contradictory testimonies, while the former head of IMT Lushnje, Shaqir Zhama, claims that his requests were ignored, other leaders of the Lushnje Municipality have forgotten the event, leaving the responsibility without the author.

On the other hand, the IKMT responded by stating that the responsibility was the Municipality of Lushnje and that their means were occupied with actions in cities like Himara or on the national roads. At one point, the bailiff Luiza Gjergjova tried to carry out the intervention with the fadroma found by the owner Dhimo Boçi himself, but the action failed due to conflicts on the ground with the family members of Genci Gjoka, which forced the intervention of the Police. After this incident, no vehicle agreed to go to that property again for fear of clashes with the owners of the building.
