The former mayor of the Skopje municipality Karposh, Stevco Jakimovski, was legally sentenced to one year in prison for the construction of the municipal building. The Court of Appeal partially confirmed the verdict against Jakimovski, that is the second-instance court upheld the one-year prison sentence for illegal constructionwhile for the crime of abuse of official position and authority, the case is returned for retrial.
Given that Jakimovski was under house arrest for five months, the time spent in detention is also included in his prison sentence, so the sentence he will have to serve is seven months, and the judge for the execution of sanctions should decide when Jakimovski will go to prison.
According to the information from the Appeal, for the crime of illegal construction, the public prosecutor’s office did not file a complaint, so the Appeal cannot affect the amount of the sentence, while for the second crime, the case was returned because there were errors in the description of the crime, that is, it is returned to the Criminal Court for technical reasons.
– Regarding the criminal offense – Abuse of official position and authority from Article 353 paragraph 4 cc paragraph 1 cc Art. 45 of the Criminal Code, the complaint of the accused is accepted and the case, only in that part, is returned for retrial. In relation to this crime, given that it was committed in the period from 2011 to 2017, the prescribed sentence is from three to five years, so according to the statute of limitations, it would expire in 2027 – the Criminal Court said, and the Appeal is waiting to publish the anonymized decision that was made.

For the municipal employee who was given a conditional sentence, the case is returned for retrial. The case that is being returned for retrial, as informed by the Appeal, will be assigned to a new judge, because the judge who acted until now is no longer part of the Organized Crime and Corruption Department.
After a six-year trial, Jakimovski was sentenced to an illegal court verdict of three years and six months in prison. According to the indictment from August 2018, Mayor Jakimovski allowed the building of the Municipality of Karpoš, where the municipal administration is located, to be built without a building permit and without appropriate architectural-urban documentation.
