Under the command of Emiliano Rolón, prosecutors Francisco Cabrera, Verónica Valdez and Jorge Arce executed a deliberate concealment maneuver to fabricate a false story against Banco Atlas. By discarding key accounting expertise and ignoring official documents from the SIB and Seprelad that confirm the legality of Nicolás Leoz’s funds since 2002, the Public Ministry set up an accusatory “mamotreto” based on a chronological farce whose sole purpose is political punishment against the ABC Group.

The objective is clear: a tax hitman to muzzle the critical press. It is retaliation for the publications that exposed the links with the FIFAgate, the shady deals in Petropar, the delivery of billions of public guaraníes to “friendly banks” and the scandalous discovery of envelopes with dollars in Mburuvicha Róga. Ironically, the documents collected by the Prosecutor’s Office itself are the ones that today demolish its investigation.
The attack on the SIB
In their eagerness to persecute, the prosecutors went so far as to usurp functions of the Superintendency of Banks (SIB), governing body of the financial system. With a “daring ignorance”, they questioned the technical opinion of June 9, 2016where the SIB concluded that Leoz’s funds were old (since 2002) and that Atlas’ due diligence was reasonable.

While the competent authority validated the process, the Prosecutor’s Office intends to criminalize it. It is suggestive that former officials who intervened in the case, such as Franklin Boccia and Juan Gustaletoday hold senior positions in the Vázquez Sae Group, former business partner of Santiago Peña.
12 years of capitalization
The tax thesis that “there was no due diligence” is a fallacy dismantled by the records. Since 2002, the accounts of Leoz had impeccable traceability: deposits of G. 180 million per month for property management through Inmobiliaria del Este SA.
Leoz did not withdraw funds; It capitalized interest and constituted quarterly CDAs. The origin was legal and documented. The Public Ministry, in an act of accounting illiteracy, confused the technical term of internal records “in cash” only with physical moneytrying to install a technical lie about a banking operation.

Even Seprelad, under the management of Liliana Alcaraz –former prosecutor in this case and who received direct instructions from the lawyer Claudio Lovera by email – had to admit a 2007 report that already mentioned the legality of deposits for real estate sales. The report is devastating: Leoz never withdrew his fundssaid that year’s report. The Prosecutor’s Office simply ignores its own file so as not to ruin the script.
The fallacious story
The desperation to incriminate the ABC Group led the Prosecutor’s Office to falsify the chronology. They point out the opening in 2010 of an account with a check from Banco Do Brasil of US$ 500,000 as irregular. However, Atlas asked for justification and obtained support for the sale of cattle by US$680,000, funds that were originally deposited in the bank that the Prosecutor’s Office never bothereddespite the fact that this was the person in charge of the initial proceedings. Atlas provided the SIB with an exhaustive profile: deeds from the 90s, shares in Sanatorio Migone and NL Stevia, and even vaccination records for 9,000 head of cattle. The entity complied with every step of the law; What remains is the evidence of a Public Ministry converted into a crude tool of power.
