Madrid/The military court investigating the case against Eduardo Ceballos, known for his humorous program Despingovery Channel and in jail since June 1 for recording a parody in a military installation, he has rejected the request for judicial control presented by the defense. The notification closes the door to holding a hearing to review the precautionary measure of imprisonment and does so, complaint the detainee’s mother, Marieta Pérez, attributing false statements to him.
The document, Pérez points out, alleges that “there are elements in the process that link the defendant to the criminal act, which was recognized by him from the first moment, as stated by the defense representative.” As a consequence of this, he argues, “the court’s decision is not to grant the request to hold a hearing in relation to the request for judicial control and to deny the modification of the precautionary measure taking into account the harmfulness of the facts associated with State Security.”

In all of them – including two without the presence of his lawyer, who had not yet been appointed –, Ceballos “flatly” denied any intention to commit a crime of espionage, which is why Pérez demands “that the real file be respected, that the narrative stop being manipulated and that a fair, transparent process adhered to the truth of the facts be guaranteed.”
For the prisoner’s mother, the court is not only denying the right to the presumption of innocence, but also lacks evidentiary elements in its argument and alters the defendant’s statements. “Justice cannot be built on distorted narratives. Transparency and impartiality are not luxuries, they are the basis of any rule of law,” he claims.
Eddy Ceballos was arrested for a program in which an abandoned military installation appeared with Soviet missiles from the 60s, radars, bunkers and disused weapons. “I’m touching an air-to-ground missile from the 1960s or so, from the Cold War. Look at this, art lovers. disjointedness”said the comedian, whose channel has more than 16,600 followers, almost 5,000 more than when he was arrested.
That video, broadcast on May 13, put him under the scrutiny of State Security, which ended up arresting him and accusing him of having shown military installations. The crimes attributed to him have penalties of up to 30 years in prison, which is why the Prosecutor’s Office and the court have been inflexible in the face of the multiple requests from the defense.
His lawyer has asked the Public Prosecutor’s Office to modify the preventive detention for another precautionary measure that does not imply deprivation of liberty, and has filed a complaint that was also rejected. Now, this new request has also failed and Ceballos will likely remain at the Combinado del Este until a trial is held, which has yet to be dated.
