The First President of the Supreme Court, Tahar Mamouni, affirmed today in Oran that: “Legal security depends on several controls, including the clarity and stability of the legal rule,” considering that decriminalizing the act of management contributed to the establishment of legal security, during his opening of the study day “Legal Security and its Impact on Economic Development,” organized by the Oran Judicial Council in partnership with the Institute of Criminology and the Oran Lawyers’ Organization.
The President of the Supreme Court mentioned a number of articles included in the Constitution that guarantee legal security, especially Article 163, which states that: “The judge is subject only to the law,” not to mention the powers of the Constitutional Court to ensure the constitutionality of laws. He also emphasized the importance of a “stable financial and banking system.” He considered that decriminalizing the act of management contributed to the embodiment of legal security in Algeria
He pointed to the importance of the investment law in preparing the business climate, in addition to creating a unified window for managing investment and granting real estate and reducing deadlines and administrative procedures, while giving the investor the right to appeal the decisions of the National Investment Agency and to appeal before the Administrative Court.
The legislator took the initiative to decriminalize the act of management and grant the social bodies supervising the institution the right to file a complaint in the event of recording mismanagement of the institution’s funds or a criminal act.
The speaker appreciated the creation of specialized commercial courts to adjudicate commercial cases and commercial movements, especially with the prospect of creating free zones within the framework of regional cooperation, which are factors that help make the business climate safe.
Finally, he called for the necessity of engaging in the national strategy for digitization, compiling legislative texts, accelerating procedures, and transparency in transactions to achieve the state of rights and law.
The President of the Oran Judicial Council, the Public Prosecutor, the President of the Bar Association, the Director of the University of Oran 1, Ahmed Ben Bella, the Director of the Institute of Criminology, and a group of interveners deliberated on the speech to enrich the topic of the study day on judicial security.
