The Vetëvendosje movement has declared in connection with the initiative to amend the Law on the Special Court sent to the Assembly of Kosovo by the Democratic Party of Kosovo.
The media office of the LVV has said that they will first wait for the decision of the Constitutional Court on the question of the constitution of the Assembly, considering that this request, which contests this process, has not been withdrawn.
It is further stated that PDK’s proposal will be carefully examined juridically so that it does not have any possible consequences, especially when the judgment against the KLA four will be processed at the level of Appeal.
The full answer of the Vetëvendosje Movement:
1. We expect the Constitutional Court to decide on the question of the constitution of the Assembly, considering that the request submitted to the Court has not been withdrawn. For this reason, we consider it necessary to first wait for the Court’s decision and evaluate the legal implications that may arise from it.
2. Regarding the proposal to amend and supplement the law, the LVV will examine it carefully from a legal point of view, including its compatibility with the legal framework in force and the effects that such an intervention may eventually have at this stage of the proceedings at the Specialized Chambers. Given that the proceedings against the four former KLA leaders are conducted with separate defense teams, each initiative must be carefully evaluated in relation to the interests and legal strategies of each case.
3. We estimate that at this stage it is more important to build a coordinated institutional and state approach, based on a complete legal analysis. Any action should be taken only after its possible legal consequences have been carefully assessed, especially in relation to the second instance procedure, namely the appeal procedure. The goal should be that the institutional actions are thought out, coordinated and do not create unwanted consequences for the judicial processes in progress.
The chairman of the PDK, Bedri Hamza, announced during the day that they have proceeded in the Assembly to amend the Law on the Specialized Chambers and the Specialized Prosecutor’s Office, which aims to limit the mandate of the Special Court in The Hague and also international monitoring of its work.
Hamza has said that since the Special was created to address the claims raised in Dick Marty’s report, the charges related to organ trafficking and crimes against humanity should be tried in The Hague, while the cases related to war crimes should be brought to Kosovo.
