The former dissident Colorado senator and former head of the Jury for the Prosecution of Magistrates (JEM), Enrique Bacchetta, recalled that he warned at the time that the then deputy Hernán David Rivas was not a lawyer, and therefore, asked that he be removed from his position as representative of the Lower House in the extra-power body. He said that no one believed his words.
The former senator Enrique Bachetta (ANR-Colorado Añetete) recalled today that the September 4, 2020in his capacity as then president of the Jury of Prosecution of Magistrates (JEM)sent a note to the then president of the Chamber of Deputies, Pedro Alliana (ANR-HC), a note in which he requested that he change to Hernan David Rivas (ANR-HC), in his position as representative of the Lower House in the extra-power body.
Bacchetta said it was because it was presumed that his law degree was not legitimate. “They didn’t pay attention to me, in fact, they always supported the representation. So much so that not even my colleagues believed me, nor did the leader of my caucus believe me, I told him that I was not a lawyer,” the Colorado senator expressed to 780 AM.
Bacchetta also recalled that the lawyer José Casañas Levy (+), when he was director of Transparency of the Ministry of Education and Sciences (MEC)began an investigation into the status of Rivas’s law degree.
“The Prosecutor’s Office had to act ex officio at that time, when I told the press that Rivas was not a lawyer, “But nothing happened.” Bacchetta stated.

Now the debate is reigniting over the alleged “mau” title of lawyer of the Chartist senator Hernán David Rivas, which even led him to preside over the Jury for the Prosecution of Magistrates (JEM).
Rivas was appointed at that time by the Chamber of Deputies on June 3, 2020while his oath as a lawyer was only given on June 11, 2020being the only one who swore that day before the then Minister of the Court Gladys Ester Bareiro de Modica (+).

The Public Ministry, through the prosecutor Patricia Sanchez, presented a extraordinary appeal before the Criminal Chamber of the Court to reverse the dismissal of Senator Hernán Rivas. In the investigator’s opinion, the Chartist’s lawyer title is false, so she hopes that the case will go to trial.
The Prosecutor’s Office yesterday presented an extraordinary appeal for cassation before the Criminal Chamber with the aim of redirecting the process against Senator Rivas recently dismissed from the case due to his alleged false title as a lawyer.
