    Tuvalu Prime Minister Feleti Teo addressed the UN General Assembly on Friday, urging decisive global action to mitigate sea-level rise and welcoming the UN’s endorsement of the Political Declaration on Sea-Level Rise.

    The landmark agreement formally recognizes the continuity of statehood and the permanence of maritime boundaries established under the UN Convention on the Law of the Sea (UNCLOS), creating a vital legal precedent for climate-vulnerable island nations facing territorial loss.

    Addressing the international assembly, Teo emphasized the legal importance of the agreement:

    The Declaration affirms that Tuvalu’s nationhood is not negotiable, that our maritime rights are not erasable, and that our people should never be forced to choose between their homeland and their future

    The low-lying Pacific island nation of Tuvalu faces extreme vulnerability to global climate change, with its most populated atolls situated only two meters above sea level. Rising ocean levels, coastal erosion, and intensified weather events increasingly threaten to submerge the country’s limited land territory by the end of the century. Despite contributing minimally to global carbon emissions, Tuvalu’s precarious geography forces its citizens and government to navigate unprecedented challenges regarding physical preservation and national identity.

    The bilateral mobility pathway aligns with the 2023 Australia-Tuvalu Falepili Union, which established legal mechanisms for Tuvaluans to access residence, healthcare, and education in Australia amid rising sea levels. More than a third of Tuvalu’s population has applied for climate mobility visas under the agreement, highlighting the urgent domestic pressures behind Prime Minister Teo’s UN address. Importantly, Article 2 of the treaty commits both nations to preserving Tuvalu’s legal statehood and sovereignty despite environmental displacement.

    Small island states like Tuvalu, Kiribati, and the Marshall Islands face existential threats to their territorial integrity as global sea levels continue to accelerate. To protect their sovereign rights, affected states maintain that baselines and maritime zone limits established under the UN Convention on the Law of the Sea remain permanent despite physical coastline changes. Additionally, expert bodies including the International Law Commission (ILC) and International Court of Justice (ICJ) have highlighted broad consensus among states supporting the uninterrupted continuity of legal statehood.

    The adoption of the declaration by UN member states establishes a critical presumption under customary international law that loss of physical land does not extinguish national sovereignty. By securing international legal consensus on enduring statehood, low-lying island nations ensure their ongoing rights to govern, maintain UN membership, and protect their exclusive economic zones. Looking forward, Pacific leaders plan to leverage this consensus at upcoming climate summits to pursue binding legal treaties and expand global adaptation funding mechanisms.

    This landmark consensus marks a decisive shift in public international law, signalling that statehood and sovereign rights are no longer tied exclusively to habitable land territory. As low-lying states navigate the dual challenges of physical adaptation and legal preservation, the international legal framework now offers a stable foundation to safeguard vulnerable populations and maintain territorial integrity into the future.
