The Royal Saint Christopher and Nevis Police Force (RSCNPF) has issued a press release reiterating that gang involvement constitutes a serious criminal offence under the laws of Saint Kitts and Nevis. The Force has further highlighted that recent amendments to the Gang (Prohibition and Prevention) (Amendment) Act, 2025, have substantially strengthened the legislative framework, introducing more stringent penalties for individuals engaged in, supporting, or facilitating gang-related activity.
Legislation now expressly prohibits the formation of a gang, participation in a gang, or any attempt to become affiliated with one. According to the RSCNPF, persons convicted of such offences are liable to imprisonment for up to thirty (30) years, while individuals identified as gang leaders or those directing gang operations may face custodial sentences of up to forty (40) years.
The RSCNPF has also drawn attention to the broad scope of conduct captured under the amended Act. This includes recruitment into gangs, inducement or coercion to join, obstruction of individuals seeking to disengage, and involvement in any criminal activity connected to a gang. The Force noted that assisting gang operations, harbouring or concealing gang members, as well as the possession of firearms, ammunition, or other materials intended for gang use, are treated as serious offences attracting lengthy prison terms.
A key feature of the amended legislation, as outlined by the RSCNPF, is the introduction of the offence of retaliatory action. This provision targets acts of violence, intimidation, or harassment directed at individuals who refuse gang affiliation, attempt to leave a gang, or cooperate with law enforcement authorities. Conviction for retaliatory action may result in imprisonment for up to forty (40) years. The RSCNPF further noted that impersonating a law enforcement officer in furtherance of gang activity is now punishable by up to thirty (30) years’ imprisonment.
In addition, the RSCNPF has pointed out that the law provides for fines of up to EC$100,000, custodial sentences of up to thirty (30) years for general offences, and the forfeiture of property linked to gang-related activity. These measures, the Force explained, are intended to dismantle the financial incentives of criminal enterprises and strengthen overall enforcement efforts.
The RSCNPF continues to urge all members of the public to avoid any form of association with gangs. The Force has emphasized that the consequences are severe and long-lasting, and is encouraging citizens to report any suspected gang activity in support of ongoing efforts to safeguard communities across Saint Kitts and Nevis.
