    The former justice minister Clemens Jabloner had warned of the “silent death” of the judiciary in 2019, and similar comments recently came from staff representatives due to the increased tasks of the courts and public prosecutors. However, as in the previous budget, the judiciary will not receive any more positions in the budget for the next two years. However, the judiciary does not have to make the will, and in the future it will no longer be allowed to do so: the possibility for citizens to draw up a will in court will be completely eliminated. There are also other plans that are intended to relieve some of the burden on the judiciary.

    “The judiciary must also fulfill its national responsibility,” said the Minister of Justice Anna Sporrer (SPÖ). The budget even includes a slight increase for the judiciary. However, the costs for (existing) staff alone will rise by 26.7 million or 2.3 percent to around 1.2 billion next year. 2.4 billion makes the finance minister Markus Marterbauer overall for the judiciary easily per year. According to him, there will be additional funding of 50 million euros in the next two years for improvements in the penal system. Inflation eats up a lot in this area too.

    The value limit for lay judges’ courts, which exists in the case of property crimes, will be raised: In the future, a lay judge’s court will only have to meet instead of a single judge if the damage amounts to more than 100,000 euros (previously 50,000). Speaking of appeal: Anyone who files an appeal in a civil case after the oral verdict has been announced should pay a flat-rate partial fee. This is simply intended to delay appeals that have been registered for tactical reasons.

    Cuts are expected in probation services. Lawyers and notaries, in turn, must continue to represent adults in court in order to compensate for the lack of capacity in specialized associations. This measure will be extended until the end of 2028.

    Anyone who is ordered to stay away from a place due to violence or stalking will in future also have to pay court fees. The judiciary also wants to save money by releasing more foreign prisoners earlier and bringing them home.
