The Government’s decision to return to Parliament with a revised Zones of Special Operations (ZOSO) Bill will provide an early test of its commitment to consultation and compromise.
The legislation is intended to target geographical areas affected by high levels of criminal activity and provide authorities with additional powers to maintain public order and safety. Homeland Security Minister Roger Alexander has argued that the measure is necessary to strengthen the State’s response to crime.
The previous bill passed comfortably in the House of Representatives but failed in the Senate after five of the six independent senators voted against it while one abstained. Its defeat was largely attributed to the Government’s refusal to accommodate amendments proposed by the independents. At the time of the debate, Attorney General John Jeremie acknowledged that some of the proposals had merit but said there was insufficient time to debate and incorporate them.
Independent senators had raised concerns about the absence of safeguards, including requirements for police officers to wear body cameras, the need for a sunset clause limiting the life of the law, and the broad powers granted to the Prime Minister. Other recommendations included stronger civilian oversight and greater protection of the constitutional role of the President in the declaration and administration of ZOSOs.
Independent Senator Dr Marlene Attzs has indicated that she is prepared to examine any revised bill and make her decision based on its contents. Her position suggests that support from at least some independent senators remains possible if their concerns are addressed.
Meanwhile, the Opposition People’s National Movement has signalled that it will oppose the legislation regardless of any amendments. While it may not have the numbers to block the bill, it is likely to challenge the measure in Parliament and seek to influence public opinion against it.
The responsibility therefore rests largely with the Government to demonstrate that it has listened to the concerns raised during the previous debate. Meaningful amendments reflecting the recommendations of the Independent Bench could significantly improve the bill’s prospects in the Senate.
Prime Minister Kamla Persad-Bissessar will also face scrutiny over her repeated allegations that unnamed independent senators sought a bribe in exchange for support of the legislation. Several independent senators have renewed calls for her to identify the individuals involved and provide evidence to support the claim.
The Government therefore faces two tests. The first is whether it is willing to make the compromises necessary to secure support for a revised ZOSO bill. The second is whether the Prime Minister is prepared to substantiate allegations that have raised questions about the relationship between the Government and the Independent Bench.
Beyond Parliament, however, the Government must convince citizens that the legislation will make communities safer without undermining constitutional rights and freedoms. After the controversy surrounding the first bill, gaining public trust may prove to be the most important challenge of all.
