    Judges await notice from the Police regarding alleged violation of house arrest – National


    Thiago Raúl Gorostiaga Arestivo He is currently facing three criminal cases for the fact of sexual coercionallegedly committed by him against three teenagers. Two of these are processed in that the act would have been committed when he was a teenager and the third, when he was of legal age.

    In this sense, the criminal judge of Adolescence Matías Garcete He is the one who understands the causes in which Thiago Gorostiaga is being prosecuted as a teenager. One of them has even been raised to the oral and public trial stage, while for the April 28 at 8:00 Garcete called to carry out the preliminary hearing in the other cases. It should be noted that both processes are in charge of prosecutor Cleider Velázquez, since prosecutor Hernán Mendoza, who was carrying out the investigations, was transferred.

    The other process is processed before the criminal court of guarantees in charge of Raul Florentin. In this case, the magistrate granted house arrest to Thiago Gorostiaga, after accepting the offer made by his defense, exercised by lawyers Álvaro Cáceres and Víctor Dante Gulino, of a real bail of G. 1,000 million.

    The defendant Thiago Gorostiaga Arestivo was filmed while he was on public roads, apparently outside his home, in the company of other young people who were aboard high-end vans. The video was uploaded to the social network Tik Tok and published by the Delpy media.

    It should be noted that in the video you can see Thiago Gorostiaga and the other boys in the middle of what would be a celebration. This would coincide with Gorostiaga’s 19th birthday, which is this Friday, April 17.

    In this regard, Judge Matías Garcete was consulted, who stated that the criminal proceedings of the adolescent jurisdiction have another treatment and that he was awaiting official communication about the apparent violation of the measure of house arrest, which must be practiced by the National Police of the jurisdiction. However, until the time of the consultation, he said he had not received any notice.

    In that sense, Resolution No. 665 of July 21, 2017 establishes the “Protocol for Police Intervention with Adolescents between 14 and 17 years of age in Transgression of the Criminal Law and for Police Protection with Boys, Girls and Adolescents at Risk“, which states that: “When police personnel verify that a teenager is violating a rule of conduct established by court order, they must proceed to draw up a report with the required formalities and notify the intervening Court without proceeding to arrest them”.

    For his part, Judge Raúl Florentín also pointed out that until the moment the query was referred to him, he had not received any type of official communication from the Police. He added that, if the report was sent after 1:00 p.m., the report had to be processed by a Permanent Attention judge.

    First case for punishable acts against sexual autonomy

    Let us remember that Gorostiaga currently has house arrest, in a case for alleged sexual coercion of which another of his colleagues was a victim. The restrictive measure of freedom was issued by the criminal judge of Guarantees Raul Florentin last August 29.

    In this case, Gorostiaga was accused by the prosecutor María Angélica Insaurralde for events that occurred during a party held on May 30, at a residence located in the Manorá neighborhood.

    In this residence belonging to one of the complainant’s colleagues, a room with mattresses had been reserved for the girls to sleep over, which is where the young woman stayed to rest, a kind of “sleepover party.”

    The complainant said that in the early morning hours she woke up scared when she felt someone groping her private parts, removing her clothes and kissing her, but she did not have enough strength to get him off of her. She explained that she was very tired because she had helped early in the organization of the party and had also taken shots of “Jäger.”

    Second trial for sexual abuse

    On September 16, the prosecutor Hernán Mendoza accused Thiago Raúl Gorostiaga Arestivo (18)for the alleged commission of punishable acts against sexual autonomy. In this framework, the researcher requested the application of the precautionary measure of house arrest and, also, the placement of the electronic anklet for better surveillance.

    In this context, on Wednesday September 24At 8:30, the hearing to impose special rules is scheduled to take place. (article 427 of the Criminal Procedure Code) before him criminal judge for Adolescence, Matías Garcete. It should be clarified that this procedure will have such a character because at the time of the commission of the reported act, the accused was a minor and therefore he is being prosecuted under special rules.

    Likewise, it should be noted that Thiago Gorostiaga, accused of sexual abuse of defenseless peoplealso faces another cause, but for sexual coerciona fact for which he was charged last August. In this case, which is in charge of the Prosecutor María Angélica Insaurraldethe young man already has the measure of house arrest.

    It is for this reason that the fiscal agent Hernán Mendoza now once again requested the application of measures such as arrest, in addition to the placement of an ankle bracelet for monitoring.

    Third case faced by Thiago Gorostiaga

    According to the account of the events presented in prosecutor Mendoza’s writing, the teenager arrived shortly before 00:00 to a party at the house of one of his friends and schoolmate, located in Assumption. In that place, the young woman was a victim of sexual violence in one of the rooms on the upper floor of the home, naming Gorostiaga as the perpetrator.

    The victim reported that after her arrival she drank a caipirinha, and then sat in the patio of the house in the company of other friends. In the meantime, other guests began to arrive, even from another educational institution other than hers and her friends. Then another young man brought him another drink, in a red glass, which he tried and did not like. After dancing, they brought him a shot that he ingested and after this, he began to feel dizzy on the dance floor.

    With the discomfort she began to feel, the owner of the house took her to the upstairs room to rest. Other friends were also with the teenager. She dozed for a few 10 minutesaccording to the accusation, and when she woke up one of those present tried to kiss her until another of the boys intervened.

    The young woman managed to recover for a few minutes, however later she felt bad again, in apparent intoxication. Faced with this situation, the owner of the house intervened, cleaned her and took her back to the upstairs room to rest and where the minor fell asleep.

    In a period of time, the young woman felt that someone was touching her. When she woke up, she realized that Thiago Gorostiaga had one hand on her and placed it on her private parts. According to the teenager’s story, she tried to get away from the boy who was forcefully blocking her, but she had no strength, and she did not know if it was because of her condition or fear.

    Later, according to the complaint, Gorostiaga placed himself on top of the victim and covered himself with a blanket in order to hide his act. After arriving home the next morning, the young woman slept for several hours and in the afternoon she noticed that she had bruises all over her body, from the struggle with Thiago, and her private parts felt irritated.

    The minor told the Prosecutor’s Office that she spoke with the school counselor, who activated the protocol. After that, she also told her parents what happened and they took her to the Barrio Obrero Hospital for a diagnosis.
