    The candidate for deputy from the Democratic Party of Kosovo, Përparim Gruda, has said that the Bureau for the Confiscation of Unjustified Assets is “tired” of the Vetëvendosje Movement.

    In the Debate on Justice on the show “Timely Elections” on KTV, Gruda stated that from the end of the February elections when the institutions were constituted until now when the Assembly was dissolved, it was possible to create this Bureau, but according to him the LVV did not want to do it.

    Gruda has stated that, in principle, it is not a matter of confiscation of property.

    “We sent it to the Constitutional Court and we won the case, we stopped it from being the way they wanted it to be, which was a repressive body and went to the Venice Commission. This Commission said that this office can be done with these criteria: it does not confiscate property, it does research, it is sent to the court, then the court decides. The Minister of Justice herself said in the commission where I was and in the Assembly that the Bureau does not confiscate, it came in accordance with the standards of Venice, but there were issues left unaddressed, they didn’t want to address them, then we voted against it, because they have had the opportunity since February, Gruda said.

    The PDK candidate for deputy has also highlighted that it is more convenient for the Vetëvendosje Movement not to establish this Office because once it is done “citizens will see that it is nothing, it does not confiscate property”.

    The Constitutional Court of Kosovo has twice declared unconstitutional the Law on the State Bureau for the Verification and Confiscation of Unjustified Assets.

    In the first decision of 2024, the Constitutional Court has assessed four articles of this law as contrary to the Constitution and, considering the importance of these articles, has declared the Law on the State Bureau invalid in its entirety.

    Meanwhile, in January of this year, the Constitutional Court found that the Assembly violated the rules when it passed this law.

    With this law, it is intended that all public officials in Kosovo be subject to asset verification if there are doubts that it was acquired illegally.

    A month ago, the Assembly approved in principle the draft law on the State Bureau for Asset Confiscation.

    81 MPs voted in favor of this bill, with 25 abstaining.

    The PDK and the LDK have requested changes in the draft law, stressing that only with the proposed changes will they vote on it further.

    The PDK has requested a public debate on this law and also cited the Constitutional Court’s remark that within this law, issues cannot be left to be regulated by by-laws. The lack of an efficient compensation mechanism was also mentioned if a person whose assets are blocked turns out to have had no unjustified assets.

    The PDK has also mentioned that the law is called the Law on verification and confiscation and it does not fit the content, since the bureau does not confiscate, therefore it cannot be named like that.

    Krasniqi: The opposition feels intimidated by Kurti

    The candidate for deputy from the ranks of the Social Democratic Party, Frashër Krasniqi, has said that the opposition parties feel intimidated by the acting Prime Minister Albin Kurti.

    Krasniqi said that an opposition that feels intimidated cannot be called an opposition.

    He said that the Bureau for Confiscation of Unjustified Assets is a political tool for lynching and control. Krasniqi said that the LDK voted for this and that the other opposition parties will also vote for it, as they feel intimidated by Kurti.

    “They feel intimidated by Kurti, as they feel that if they don’t accept it then Kurti will say that you have unjustifiable wealth to hide and that is the reason why it is not accepted”, said Krasniqi in “Zgđedjej ne Kohë”.

    He said that it is impossible to fight “authoritarianism, if all the time there are signs of readiness for a coalition with it”.

    Krasniqi said that the problem that Kosovo has today is the lack of opposition legitimacy.

    “You come out complaining that for 5 years the prime minister has captured the state, and for 5 years you had Vjosa Osmani as president who stayed with Kurt until the end. And at the very end he told him that he wanted to cooperate with you again. When the LDK comes out or Osmani talks about the captured justice system, the citizen automatically says, well, since he is like that with authoritarian tendencies, why did you want to cooperate with him. This is losing his legitimacy opposition and is making it non-existent”, said Krasniqi.

    He said that Vjosa Osmani has not decreed the chief prosecutor of the state for 4 years and more, going to Kurti.

    “We have been without a chief prosecutor for 4 years, with an acting chief prosecutor for 4 years, and we are still here. Do you know why? After Kurti came out and said that ‘so and so pistachio, you never became chief prosecutor,’ and the president stayed behind Kurti’s statement and did not decree it permanently for 4 years, even to this day we are without a chief prosecutor”, said Krasniqi.

    He also said that the Democratic Party of Kosovo constantly criticizes Kurti for trying to control all the institutions, to create an autocracy, and in the end does not set red lines for the Vetëvendosje Movement.

    “One person has even gone further, the representative of PDK, Arian Tahiri, has publicly stated that ‘we will make him the quorum for president after the elections, because we will not leave the country by going into a crisis.’

    Bardhyl Hasanpapaj, a candidate for deputy from the list of the Democratic League of Kosovo, has criticized the Vetëvendosje Movement, saying that during the nearly six years in power it has only blocked and attacked the judicial system.

    Hasanpapaj also commented on the Office for Confiscation of Unjustified Assets, saying that it is political and that it only aims at lynching and attack.

    “That Bureau for confiscation is a bureau for lynching. Five years of deadlock, five years of stagnation, blockage, attack on justice, the judicial system. Five years of justification. Everything they have done has been justified. They have drawn up laws, it seems, with bad intentions, with the idea that they will go to the Constitutional Court, and they will clearly be overthrown,” said Hasanpapaj in “Elections in Time”.

    He said that the ruling party has done politics with justice, constantly attacking it.

    “It’s a political issue, so if you weaken it, destroy it and label it, then develop informal mechanisms with more control,” he said.

    As for the Bureau, he has compared it to the committees of Albania during communism.

    “That bureau is political. It is a system of the Central Committee of the Labor Party of Albania. That bureau for confiscation is a political bureau for lynching and attack,” said Hasanpapaj.

    He said that the LDK has in its program that “justice develops independently, offering sufficient mechanisms to be independent”.
