    “Many of these people are convinced that they will have European immunity and that their future is secure. In my opinion, they are deeply mistaken, but this belief creates a sense of impunity that spreads to lower levels of public authority – deputy ministers, officials, judges, prosecutors are convinced of their own impunity. You are deeply mistaken, and if you know me, I do not speak lightly,” – this is how the President of the Constitutional Tribunal, Bogdan Święczkowski, commented on the investigation into an alleged coup.

    At the beginning of February 2025, the President of the Constitutional Tribunal, Bogdan Święczkowski, announced that he had filed a notification of a suspected coup attempt by, among others, Donald Tusk, ministers, politicians of the ruling coalition, and certain lawyers. The investigation was initiated by prosecutor Michał Ostrowski.

    In April 2026, the District Prosecutor’s Office in Warsaw partially discontinued the investigation into the alleged coup, finding that actions taken by members of parliament and state bodies aimed at bringing the former head of the National Broadcasting Council before the State Tribunal were lawful. The thread concerning alleged undue pressure on members of the National Electoral Commission during work on the financial report of the election committee of Law and Justice (PiS) from the 2023 parliamentary election campaign was also discontinued.

    Asked about the matter today on TV Republika, the President of the Constitutional Tribunal, Bogdan Święczkowski, explained that filing the notification about a “coup” was intended as a signal to “wake up” certain politicians.

    “Why did I file a notification about a coup? Because I believed that this government might cross certain boundaries, and then citizens would conclude that they must take matters into their own hands, which would lead to a revolt. I believe we should avoid that, because every revolt involves bloodshed, so this notification of a crime was meant to sober up those who are engaging in such actions, that they may cross a thin red line and lead to a revolt in the country, when people take to the streets and blood is shed. I wanted to avoid that, which is why I called and continue to call on Donald Tusk, the Speaker of the Sejm, to engage in dialogue, but there is no reflection on their side”, said Święczkowski.
