The Nomination Commission for Attorney General closed the most decisive phase of the process when voting and forming the final list of six candidateswhich has already been sent to President Bernardo Arévalo.
With this decision, the mechanism enters its final and most sensitive section, in which The Executive must appoint the next head of the Public Ministry before May 17date on which the current period ends.
The result of the vote left one of the most relevant facts and with the greatest political impact: the exclusion of the current attorney general, Consuelo Porras, who failed to make the final list despite having participated as an applicant.
His departure occurs in a context of sustained tension with the Arévalo Government, marked by decisions of the Public Ministry that generated clashes with the Executive and by questions from different social sectors, academics and the international community about his management.
The exclusion also breaks with the possibility of immediate continuity in the position and opens a scenario of replacement in the leadership of the investigative entity.

The six profiles come from diverse backgrounds within the justice system, including experience in the Public Ministry, private litigation, academia and public service, but also accusations and questions from institutions observing the process.
The integration of this payroll is the result of a process that included the evaluation of 48 applicants who passed the initial phasespublic interviews and which were reduced with the application of a 100-point grading table, with a cut-off line of 75 points that was later reduced to 70.
In practice, this meant that only those who reached that threshold could be considered in the final vote, in which the commissioners ordered the candidates from highest to lowest score before defining the final list. This mechanism, although technical in its design, has historically been the subject of debate due to the weight that political factors may have in the final decision.
The process, however, is not yet completely closed. The regulations establish a phase of challenges that may affect the result.
At this point, both the Consuelo Porras, like any other candidate who was left out, can challenge her exclusioneither before the same commission or through legal actions in jurisdictional bodies, which could delay or modify the course of the process.
This type of resource is not unusual in application processes and, on previous occasions, has generated reconfigurations in payrolls or questions about the transparency of the procedure.

The final decision
Once the challenges phase is over, the process is completely transferred to the Executive. President Bernardo Arévalo must choose the new attorney general from among the six candidates, without being obliged to follow the order of points or the vote obtained in the commission.
The change in the leadership of the Public Ministry must take place on May 17, when Consuelo Porras’ term ends. The decision adopted by the Executive will not only define a name, but also the direction of the institution in the next four years, in a context marked by tensions between powers of the State, questions about the functioning of the justice system and expectations of changes in the criminal prosecution policy.
In this scenario, the election acquires strategic weight since the profile that is designated will mark the relationship between the Public Ministry and the Government, as well as the orientation of high-impact cases and the institutional response to demands for transparency, independence and the fight against corruption.
