The Court of Courts held this Monday the oral hearing against a man accused of felony injury for the alleged assault on the ex’s sister owner of a motorcycle workshop during a discussion about payment for a repair. The defendant explained that he maintained a “relationship of trust” with the owner of the workshop because he had been bringing his motorbikes there for years and that their intention was to pay for the replaced parts, but not the labor. As stated, the discussion he tensed when the mechanic’s sister announced who would notify the police. The man assured that, at that moment, he felt cornered and just wanted to leave the premises. He has admitted that he pushed the woman aside to try to get out, however he has denied punching him. He also stated that, right after, the owner of the workshop grabbed him by the neck and strangled him until a worker separated them and he was able to go outside.
The alleged victim has offered a completely different version. He has declared that he will be the accused who reacted violently knowing that the police would be called. According to his account, while he opened the door to wait for the officers, the man gave him punched her in the face and pushed her, which forced her to hold on to the door to avoid falling. After the events, he explained that she suffered from anxiety, difficulty sleeping and a constant sense of helplessnesswhich is why he underwent psychological treatment during several sessions.
For his part, the former owner of the workshop i has corroborated the account of his sister i he has denied strangling the accused. He has assured that he only held him by the sweater to push him away after the assault and has remembered that the repair bill it was never paid. A neighbor and client of the victim says he saw the assault and called the police. With the statements of the parties and the witnesses, the Court of Justice will now have to decide which of the two versions considered accredited before passing judgment.
