For 5:00 p.m. this Friday, April 24, 2026, the president of the National Assembly called, Niels Olsento plenary session 088 to hear the request for authorization from the national judge (e) Marco Aguirre Torres to start a criminal proceedings against the assembly member of the National Democratic Action (ADN) bench Diana Jácome for the alleged crime of slander.
The session will be virtual and has two agenda items: the first, the national anthem; and the second, knowledge of the office of the judge of the National Court of Justice (CNJ).
The magistrate asked Parliament for authorization after a complaint filed by the assembly member and coordinator of the Citizen Revolution (RC) bench, Juan Andrés González, who alleges that Jácome had incurred slander for saying:
“I recommend that you wear good pajamas for anything, and I hope you find a good room in the Cárcel del Encuentro with Wilman Terán, whom you saved…”.
The ADN assemblywoman referred to the Correismo legislators and it occurred in session No. 067 of the plenary session of the National Assembly, held on February 5, 2026.
According to González, legislator Jácome “would have engaged in conduct that exceeds the legitimate exercise of parliamentary debate, turning personal disqualification, veiled threats and humiliation into systematic tools of political intervention.”
The criminal action indicates that the expression was directed at a specific group of legislators, among whom was assemblyman Juan Andrés González.
This phrase issued, the writing says, suggests the imminence of raids and deprivation of liberty (“wear good pajamas”); implicitly attributes the commission of criminal conduct; and links the complainant with citizen Wilman Terán, who registers a criminal sentence, generating a direct association with illegal activities.
It also maintains that the conduct was carried out consciously and voluntarily, in a context of political debate, but exceeding the limits of criticism, with knowledge of its capacity to affect the honor and reputation of the complainant.
The Organic Law of the Legislative Function in its article 111 determines that, if the Assembly does not respond within the period of 30 days to the judge’s request, it will be understood as granted. The date of entry of the judge’s request to the National Assembly is March 27, 2026.
To lift the parliamentary immunity An assembly member requires the support of the qualified majority in the National Assembly, that is, at least 101 votes of the legislators.
The crime of slander is established in the article 182 of the Comprehensive Criminal Organic Code (COIP)which says:
“The person who, by any means, makes a false accusation of a crime against another will be punished with imprisonment. six months to two years”. (YO)
