    “Milo and Mrva are bombers, arrest them immediately”, is one of the messages that Radoje Zvicer sent to the accused police officer Petar Lazović in the last days of 2020, via the once protected Sky application.

    That and numerous other messages were read today in the courtroom of the Basic Court in Podgorica, at the trial of suspended police officers Petar Lazović and Jugoslav Raičević, who are responsible for abusing two alleged members of the Skalja cell of the Balkan drug cartel.

    Lazović and Raičević are responsible for the alleged torture of Jovan Mrvaljević, after he was detained in Nikšić at the end of December 2020. Lazović is also on trial because, according to the indictment of prosecutor Biljana Pavličić, he also tortured Mrvaljević’s colleague from the clan, Milo Jovanović.

    Before Zviter asked for the arrest of the thieves, the policeman informed him that they had been taken into custody in Nikšić. After that, the leader of the blackmail cell of the criminal clan forwarded to him a photo of a man with a slimmer build, dark brown hair and a thin beard, whom Judge Ilija Radulović stated matched Milo Jovanović’s appearance.

    “There is no point in arresting anything,” he wrote in one of Zvicer’s messages, which he sent after the “report” that was found with Mrvaljević, Jovanović and Vladan MIjušković.

    In the continuation of the communication, as it was read in the courtroom, Lazović sends photos of personal documents and traffic licenses, which refer to Milo Jovanović, Vladan Mijušković and Jovan Mrvaljević, as well as a photo of the black pistol that is on the seat of the vehicle.

    “I’ll go, if they don’t know, to try to scare them,” Lazović sent.

    With the order to immediately arrest Milo and Mrva, Zviter then sent: “And I had them. Mijušković was a spy. Even the other two. One of them is that picture on the motorcycle”…

    A few hours later, Switzer received a photo from the hospital room, showing a man attached to an EKG machine.

    “This one dies for me, pi”, wrote Lazović…

    The judge concluded that the person in the photograph corresponds to Jovan Mrvaljević in terms of physical constitution.

    A voice message was heard in the courtroom, where several people can be heard shouting.

    Judge Radulović noted that the communication was reminiscent of a certain crowd, but also that a male voice could be clearly heard, saying:

    “You stinky bitch, who would kill your family?”.

    The judge noted that before asking the question of who is going to kill your family, you can hear a loud scream and the voice of another male person, but what he is saying is indistinct.

    “So the man managed to intimidate you so much,” asked the voice that was heard dominantly all the time, and then continued: “But what.”

    Then another voice is heard saying – “Well, he didn’t scare me”. The judge noted that it was said with an accent that corresponds to the Nikšić-speaking area.

    “And how, why should he kill her? And listen to me tell you something, you will tell Jovica Vukotić, they told me from the Special Team, Petar told me, to knock you and everything you own. Feel free to tell him that, I will eat you in the mouth and you and him, do you understand now? Do you understand now, do you understand now that one piece of shit, now you will see”…

    The judge noted that this person speaks in a raised imperative tone all the time, while the other person says something at certain moments, but it cannot be heard clearly on the recording.

    The continuation of the communication was also read, with pins that, according to the Special State Prosecutor’s Office, belong to Zvicer and Lazović:

    Swiss: Is he alive. Oh brother?

    Petar: You’re a scumbag.

    Switzerland: It’s fine in the afternoon. He’s going to fix drug addicts. Did they say what?

    Petar: Two of them were with us, the third admitted that his gun was in NK and they immediately arrested him. The one who was with me is dead, and the one with the other group was just talking, they will kill him if he tells the code. They warned them and let them return the crypts, now they will follow them…

    Switzerland: Who took the inlet?

    Petar: This Mijušković, but he will talk a lot about honoring him, father, I felt him. Crumb.

    Switzer: Are they evils?

    Petar: Brother pi. Last, Tranje, those who made me and you will be imprisoned.

    Switzerland: You speak well. Here’s the old man, let go of what you said about the clepma to put it on the house.

    After that message, he also sent a photo showing his hand and stomach, and the judge notes that it would appear to be a male person holding a bottle of beer.

    “In front of him on the table is a mobile phone and glasses, in the background is a Christmas tree and decorations”…

    Zvicer: The old man said, “All honor to him, he introduced him to the house by his first and last name.”

    Petar: You know that my brother doesn’t play tricks… and I’ll be in the newspaper right away tomorrow

    Zvier: Well, let those journalists smoke the house. Come on brother.

    Petar: I don’t burden myself at all. Have you had any Meganes stolen in PG? And do you know who this is?

    Before reading the correspondence from the once-protected Sky application, the defense lawyers requested that it not be used as evidence, pointing out that it was not obtained for the purposes of that procedure…

    The judge rejected the lawyer’s proposal to inspect Mrvaljević’s house

    In the first part of the trial, digital forensics expert Balša Savić testified today, who examined the phone of the injured Mrvaljević.

    “Photographs of people and recordings of appetizers from Jovan Mrvaljević’s phone are not known to the injured party, except for one taxi driver from Nikšić,” said his legal representative, lawyer Tatjana Pavlićić.

    For this reason, she expressed her suspicion that the phone that was examined was not Mrvaljević’s and proposed to the court that, in order to verify those allegations, they should inspect the family home of that alleged member of the Skalja cell of the Balkan drug cartel.

    Judge Ilija Radulović rejected her proposal.

    Previously, the defense attorneys of the defendants Petar Lazović and Jugoslav Raičević also opposed the tour of Mrvaljević’s house.

    Radulović reasoned that a different decision would lead to a delay in the proceedings.

    Before the decision to reject the proposal, the court expert for digital forensics, Balša Savić, said that he extracted the data that was in the phone he was testifying on.

    “Certainly, I did not add or remove anything from the files, but everything is as it was on the mobile phone,” Savić said in response to the question of lawyer Pavličić – whether he added any files, because the dates do not match…

    She explained that while reviewing the material, she saw that there was a file that was created after the confirmation of confiscation of the phone was issued, which, she states, indicates that it can be manipulated.

    “I reviewed the CD with the injured party, he said that of all the persons in the photos, he knows only one man, a taxi driver from Nikšić. He does not even know the rooms in the photos, nor the areas, which raises doubts that the phone that was examined is his at all. In the direction of the claims I made – that the objects shown in the photographs, which are an integral part of the findings of the digital forensics expert, do not correspond at all to the object where the injured party lives, I suggest that the court inspect the family home of the injured party,” she said. Pavlicic.

    Basic state prosecutor Biljana Pavličić left it up to the court to decide whether to accept that proposal, which was opposed by the defense attorneys of Petar Lazović, lawyers Borivoje Borović and Nikola Martinović.

    Borović: The phone that was taken from the injured party is the one that was expertly tested

    Borović said that the attorneys of the injured have been trying to lead the court process from the beginning:

    “It turns out that the witnesses, the police officers, are not telling the truth, that the experts are not telling the truth. The phone that was taken from the injured party is the one that was examined,” said Borovič.

    Martinović pointed out that the phone was not examined in order to see the environment in which Mrvaljević lives, but to determine whether there are photographs of injuries in it, as claimed by Mrvaljević.

    Lazović’s third defense attorney, lawyer Marko Radović, asked the expert what he also asks him in other cases in which he testifies as a digital forensics expert – where he is employed.

    “In the Special State Prosecutor’s Office,” replied Savić.

    After the hearing of that witness was over, Judge Radulović read that the correspondence from Skaj had been delivered to him.

    Mravljević’s legal representative objected to the introduction of that evidence, arguing that she contests those correspondences in all proceedings.

    This was also done by the defense attorneys of the defendants, asking the court to exclude them as legally invalid evidence.

    Radović said that he would not only problematize the issue of legal validity, but also its evidentiary usability in the specific procedure.

    “I think the time has come for the courts in Montenegro to do something positive for Sky – to pass a decision whose sentence will be that it cannot be used, because it was submitted for the purposes of another proceeding. The competent authorities in Montenegro misled the competent authorities in France,” he said, referring to the decision of the court in Belgrade, which returned the indictment for the same reason in the case of double murder.

    Attorney Martinović questioned the identification of the users of certain pins, pointing out that it was previously discussed in the High Court that it cannot be done by the Montenegrin police and the prosecutor’s office.

    The defendant Petar Lazović said in the courtroom that his only contact with that application was when someone was arrested, so he voluntarily opened the encrypted phone and explained to them who was hiding behind which pin.

    He accused the Special State Prosecutor’s Office of abusing Sky and relegating him to the Basic State Prosecutor’s Office.

    The trial continues on July 9, when closing arguments are planned.
