A man who took advantage of a child leading to her having his son will learn his fate next month.
Assistant Director of Public Prosecutions Basil Cumberbatch is seeking a sentence between 12 and 15 years for Jakyle Barry, while his lawyer Glendon Rolle has suggested a sentence between two and five years.
After hearing from probation officer Deah Duvalier, Justice Renae McKay on Friday adjourned her sentencing decision to May.
Barry, 23, pleaded guilty to 11 counts of unlawful sexual intercourse before his trial began last November.
Barry, then 19, began an illegal sexual relationship with a 12-year-old girl on a Family Island in August 2021 after they were reportedly introduced by cousins. The relationship continued until April 2022 when the girl became pregnant at 13.
Although the minor willingly had sex with Barry, she could not legally consent because she was under 16.
His victim is now 17 and about to graduate from high school. The boy she had with Barry is now two years old.
Barry expressed remorse during his interview with the probation officer. He said he would like for him and his child’s mother to become a family once she reaches adulthood.
The minor said that she would like Barry to play a role in their son’s life. He was prohibited from contacting the mother while on bail for the offense.
