Ernestina Godoy Ramos, head of the Attorney General’s Office (FGR), reiterated that the derailment of the Interoceanic Train in Oaxaca, which left 14 dead and a hundred injured in December of last year, was not due to a problem in the work promoted by the former president Andrés Manuel López Obrador.
In a message to the media, the prosecutor reported that after a thorough inspection the quality of the road at the point of the accident was confirmed, in the Z lineand the locomotives, and both comply with the applicable standard.
“After a thorough inspection and sampling, it was confirmed that at the point of the accident the track, sleepers, fixings and ballast comply with the standard,” he indicated.
Godoy Ramos assured that the Public Ministry in the case accredited the alleged responsibility in the crimes of homicide and negligent injuries of the driverFelipe de Jesús Díazand the train dispatcher Ricardo Mendozathe only two arrested in this case.
“As a result of the investigations, the public ministries, after integrating four investigation folders, reliably accredited the commission of the crimes of homicide and negligent injuries with the participation of the train driver, the driver and the head of office, which is why the investigation was brought before a judge in a timely manner, with which arrest and search warrants were obtained.
Subsequently, the initial hearing was held in which orders to join the process were obtained.”
He indicated that the operating company of the Interoceanic Train, run by the Secretary of the Navy, decided to grant pardon to the detainees for the crime of damage to national property.
Ernestina Godoy Ramos reported that victims of the derailment of the Interoceanic Train opted for alternative justice for the signing of reparatory agreements for the extinction of the criminal action.
According to what the attorney general explained, 145 people, 114 adults and 31 children and adolescents, have “immediately” received comprehensive reparation for the damage.
Therefore, criminal action was ruled out against the company Ferrocarril del Istmo de Tehuantepec, of the Ministry of the Navy, for the crimes of illicit use of powers and improper service of the public service, since it provided information on audits and contracts of tracks and rolling stock that did not merit criminal action from the Anti-Corruption Secretariat or the Superior Audit of the Federation, agencies that carried out a review of them.
