FTC warns against unjustified price hikes amid global pressures

The Fair Trad­ing Com­mis­sion has warned busi­ness­es against us­ing glob­al un­cer­tain­ty as cov­er for un­jus­ti­fied price in­creas­es, sig­nalling clos­er scruti­ny of mar­ket be­hav­iour as it moves to en­force com­pli­ance un­der the Fair Trad­ing Act, Chap 81:13.

In a news re­lease is­sued yes­ter­day, un­der the over­sight of its new­ly ap­point­ed Board of Com­mis­sion­ers, the Com­mis­sion said it is mon­i­tor­ing the im­pact of in­ter­na­tion­al de­vel­op­ments on sup­ply chains and in­put costs, but made it clear that such pres­sures do not jus­ti­fy an­ti-com­pet­i­tive con­duct.

The reg­u­la­tor said busi­ness­es must en­sure pric­ing and com­mer­cial prac­tices re­main fair, trans­par­ent and law­ful, even as ex­ter­nal shocks af­fect op­er­at­ing con­di­tions.

It cau­tioned that price in­creas­es must be ground­ed in le­git­i­mate cost pres­sures and ac­com­pa­nied by clear, time­ly dis­clo­sures to the pub­lic. Those dis­clo­sures, it said, should out­line the main fac­tors dri­ving any ad­just­ment, warn­ing that a lack of trans­paren­cy could raise con­cerns about whether in­creas­es are jus­ti­fied.

The Com­mis­sion stat­ed that any at­tempt to in­flate prices be­yond rea­son­able lev­els will at­tract scruti­ny and could amount to a breach of the law, par­tic­u­lar­ly where there is ev­i­dence of col­lu­sion be­tween com­peti­tors, abuse of a dom­i­nant mar­ket po­si­tion or oth­er an­ti-com­pet­i­tive prac­tices.

It said it will ac­tive­ly mon­i­tor mar­ket ac­tiv­i­ty and take ac­tion where nec­es­sary.

The warn­ing comes amid height­ened sen­si­tiv­i­ty among con­sumers and busi­ness­es over ris­ing costs and sup­ply dis­rup­tions linked to glob­al eco­nom­ic shifts. The Com­mis­sion’s in­ter­ven­tion sig­nals a stricter en­force­ment pos­ture as it seeks to main­tain com­pet­i­tive con­di­tions in the do­mes­tic mar­ket.

Stake­hold­ers, in­clud­ing con­sumers and busi­ness­es, are en­cour­aged to re­port con­cerns, es­pe­cial­ly re­gard­ing sud­den or sig­nif­i­cant price in­creas­es that may be linked to an­ti-com­pet­i­tive be­hav­iour.

The Com­mis­sion re­it­er­at­ed its man­date to pro­tect con­sumers and pro­mote fair com­pe­ti­tion, adding that it will con­tin­ue to track de­vel­op­ments to safe­guard the in­tegri­ty of the mar­ket­place.
