This week, President Karol Nawrocki will submit a motion to the Constitutional Tribunal to resolve a competency dispute regarding the swearing-in of judges in the Sejm, the head of the Presidential Chancellery Zbigniew Bogucki announced. As he stressed, the aim is to assess “whether it was possible to carry out this stunt, this buffoonery,” and the president’s decision is to be based on the provisions of the Constitution.
Speaking on Telewizja Republika, Bogucki said that the president would file a motion with the Constitutional Tribunal this week to resolve the competency dispute over the swearing-in of judges in the Sejm.
“This means determining whether it was possible to carry out this stunt, this buffoonery that took place in the Sejm and call it a swearing-in,” the head of the Presidential Chancellery specified.
He also assured that the president has “absolute awareness that this cannot be done.” However, as Bogucki said, “he is a statesman and follows the path of the Constitution.”
Bogucki was also asked what decision the president would make if the Tribunal were to rule that the swearing-in of the four judges had taken place in violation of the Constitution. He replied that one should wait for the ruling, although the issue of “impeccable character” arises here and—according to him—“those individuals chose a path inconsistent with the law.”
He added that some of those individuals had been “very strongly politically engaged” and, as he put it, “there is a certain level of absurdity that these judges (…) have crossed.”
“I think the president has never taken part in buffoonery, because here ‘cabaret’ would be far too mild a word,” the head of the Presidential Chancellery concluded.
