Prosecutors Patricia Sánchez and Luz Guerrero presented an extraordinary appeal for cassation through which they ask that the Chartist senator Hernán Rivas face a new preliminary hearing in the case of his alleged false title. Agent Sánchez had been warned about possible “consequences” in the event of filing any appeal against the legislator’s dismissal.
The agents of the Public Ministry, Patricia Sánchez and Luz Guerreropresented this Tuesday a extraordinary appeal of cassation so that the recently dismissed Hernan Rivas return to face a preliminary hearing in the case of his alleged fake law degree.
The appeal was presented despite the warning that Agent Sánchez received, supposedly from a senator whose identity was not revealed.
The agents file this appeal against the resolutions issued by the Court of Criminal Appeals, Second Chamber of the Capital, made up of judges Delio Vera Navarro, Bibiana Benítez and José Agustín Fernández. The latter had cast a dissenting vote.
On that occasion, the Court resolved the definitive dismissal of the Colorado Chartist senator Arguing that the punishable act provided for in Art. 251, paragraph 1 of the Penal Code (mediate production of public documents with false content) expired, even before the formulation of the indictment, the Public Ministry charged late.
The prosecutors request the annulment of this resolution and order the forwarding of the case to another criminal court with guarantees for the substantiation of a new preliminary hearing in order to redirect the process, according to the document presented.

Intimidation of the prosecutor
On March 31, one day after Rivas was acquitted, prosecutor Patricia Sánchez informed the State Attorney General’s Office that he receiveda message attributed to a national senator” and that it was directed specifically at her.
“Therein reference would be made to possible consequences on his permanence in office in case of filing an appeal in a criminal case of interest to the aforementioned legislator,” details information released by the Prosecutor’s Office.
This Tuesday, Senator Rafael Filizzola, of the Progressive Democratic Party (PDP), presented a draft resolution so that it is the Chamber of Senators that formalizes a request for reports from the Public Ministry on the alleged intimidation of prosecutor Patricia Sánchez before the inaction of the president of the Senate Basilio “Bachi” Núñez (ANR, HC).
