    Viktor Orbán Rejects Implementation of EU Anti–Child Protection Ruling

    The Hungarian government refuses to comply with the ruling of the European Court of Justice, Magyar Nemzet reported. Viktor Orbán stated that they would not implement the ruling regarding the Child Protection Act. Fidesz Parliamentary Leader-Elect, Gergely Gulyás, emphasized that more than three million voters support the law and that Hungary will make no concessions on matters of child protection.

    As is well known, shortly after the elections in Hungary, the Court of Justice of the European Union issued a ruling against the Hungarian law on protecting children from pedophiles in the proceedings initiated by Brussels.

    In the view of the Luxembourg court, the legislation violates EU law in several respects, particularly the provisions on fundamental rights and the functioning of the internal market. Based on the ruling, the court objected to restrictions on content related to “gender identity” in the media and in advertising, which it considers incompatible with EU regulations. Furthermore, it deemed certain elements of the registry for individuals who have committed pedophile crimes to be unlawful.

    Gergely Gulyás emphasized in a Facebook post that since the fall of communism, no issue or party in Hungary has received as much support as the Child Protection Act.

    the politician said.

    The future leader of the Fidesz parliamentary group made it clear: the outgoing governing parties are convinced that the state should not dictate how people should live their lives, but that the protection of children and their physical and mental development must be ensured through strict regulations. There is no place for gender propaganda here.

    Gulyás emphasized, however, that the issue of child protection is an important matter for Hungary and that “we must make the relevant decisions ourselves.”

    The outgoing prime minister informed President Tamás Sulyok in a letter of the Hungarian government’s position on the matter, which the future parliamentary group leader had attached to his statement. In his letter, Viktor Orbán pointed out that the EU court’s ruling seriously infringed upon both Hungary’s sovereignty and its constitutional identity.

    I hereby inform you that, in light of the political, legal, and constitutional concerns regarding the Court’s ruling, the Hungarian government will not implement the decision of the Court of Justice of the European Union,”

    Orbán wrote to Sulyok.

    Fact

    In 2022, a referendum on protecting children from LGBTQ ideology was held concurrently with the parliamentary elections. Even though the referendum had to be declared invalid because about 20% of voters cast invalid ballots on the four questions (not only the opposition but also non-governmental organizations urged Hungarians to cast invalid votes), the rejection of “gender-sensitive” education for children is evident.
