The Minister of Housing, Conxita Marsolhas defended that rental contract extensions will be automatic with the new thawing law. In response to social democratic general councilor Pere Baróhas assured that the Government’s lawyers have analyzed the text and consider that it makes it clear that the extensions are established by law, without the need for tenants to express the will to renew.
The debate at the session of questions to the Government in the General Council took place as a result of a judicial resolution of the Superior Court which requires tenants to have expressed the will to renew the contract in order to benefit from the extensions provided for in the Law on measures to stimulate and stabilize the housing rental market, approved in 2023. Marsol has acknowledged that the Government has located a second sentence along the same linesbut has ruled out, at the outset, modifying the regulations because the changes would not have retroactive effects and the text will cease to be in force in December.
Baron has warned that this interpretation can harm families and has demanded measures beyond existing aid. The minister has guaranteed that particular cases will be studied and has not closed the door to introducing modifications if they are shown to be necessary.
