    After Trump Pardon, Former Honduras President Hernández Faces Charges in His Home Country


    Just eight months ago, Juan Orlando Hernández was beginning a 45-year prison sentence in a West Virginia federal penitentiary for sweeping drug trafficking and weapons charges.

    Now, Mr. Hernández is back on home soil to face justice in his country.

    A former president of Honduras, he was extradited to the United States in 2022 following charges of operating his country as a “narco-state” and saying that he would “shove the drugs right up the noses of the gringos” by flooding the United States with cocaine. Two years ago, he was found guilty in a U.S. federal court. But after his family and right-wing political operatives lobbied for his release, President Trump granted him a pardon in November.

    “Today I came back to my homeland,” Mr. Hernández, who served as his country’s leader from 2014 to 2022, told a crowd of cheering supporters upon his return just over a week ago. “I come to be just another Honduran who builds, uplifts and unifies — both inside and outside my party.”

    However, his homecoming starts a new legal battle.

    Despite having his U.S. conviction wiped clean, and delaying his return home until after a Honduran arrest warrant against him was suspended, Mr. Hernández remains a target in an enormous anti-corruption investigation in Honduras known as the Pandora Case. The inquiry centers on a network of lawmakers and high-ranking politicians who, from 2010 to 2013, are said to have diverted public funds meant for social programs, agriculture and poverty reduction.

    They then funneled that money, Honduran prosecutors say, into private foundations to finance political campaigns — including Mr. Hernández’s successful 2013 presidential bid. He has maintained that the accusations against him are politically motivated.

    Here is what to know as Mr. Hernández steps back into the spotlight to face Honduran justice.

    What did a U.S. court find him guilty of?

    Less than three weeks after Mr. Hernández stepped down in 2022 from his second presidential term, U.S. authorities requested his arrest and extradition from the newly installed left-wing government in Honduras.

    Shortly after, elite police units surrounded his home in Tegucigalpa, the capital, and he was flown in handcuffs to the United States.

    In 2024, a federal court in New York found Mr. Hernández guilty of using Honduras as a primary transit hub for 400 tons of U.S.-bound cocaine and authorizing the use of machine guns and grenade launchers to protect a drug trafficking emporium.

    In court, Judge P. Kevin Castel called Mr. Hernández “a two-faced politician hungry for power” who posed as an antidrug warrior while secretly partnering with traffickers. Before being sentenced, Mr. Hernández insisted that he had been the target of political persecution.

    “It’s as if I had been thrown into a deep river with my hands bound,” he said.

    U.S. prosecutors also said that Mr. Hernández received “millions of dollars of drug money” from criminal actors, including from the notorious Mexican drug lord Joaquín Guzmán Loera, known as El Chapo.

    Why did Trump pardon him?

    Mr. Hernández’s cause was taken up by conservative figures like Roger J. Stone Jr., who was himself pardoned by Mr. Trump in 2020. Mr. Stone, a longtime friend and ally of Mr. Trump, admitted to personally delivering a pardon request to the White House in 2025, arguing that the political left had wrongfully framed Mr. Hernández.

    Though the investigation into Mr. Hernández’s ties with drug traffickers primarily took place during Mr. Trump’s first term, the White House said he had been “set up” and targeted because “he was opposed to the values” of the Biden administration.

    “There was virtually no independent evidence presented,” Mr. Trump’s press secretary, Karoline Leavitt, told reporters after the pardon in December, adding that Mr. Hernández’s conviction relied heavily on the testimony of “admitted criminals” seeking reduced sentences.

    Mr. Trump’s pardon also coincided with his endorsement of a right-wing presidential candidate from Mr. Hernández’s party, Nasry Asfura, who went on to win last year’s elections.

    What charges does he face in Honduras?

    Honduran prosecutors have brought fraud and money-laundering charges against Mr. Hernández, accusing him of siphoning roughly $2.4 million in public funds, including from the Ministry of Agriculture, to finance his 2013 presidential bid while he led the National Congress.

    The money was allegedly laundered through two nonprofits to disguise its public origin before being funneled into his campaign.

    In December, the Honduran attorney general issued an international arrest warrant and an Interpol Red Notice seeking Mr. Hernández’s detention. But in June, both were suspended after the country’s judiciary accepted his request to turn himself in voluntarily.

    What do people think of his return?

    Mr. Hernández’s arrival in Honduras has fractured public opinion.

    Last week, a nationwide survey by ERIC-SJ, a Jesuit human rights center, found that 52 percent of participants opposed his return. But 46 percent supported it.

    For his supporters, Mr. Hernández is a victim of political persecution whose homecoming feels like total vindication. For critics, he remains the ultimate symbol of state corruption.

    “Seeing Juan Orlando set foot in Honduras again fills me with a great sense of peace,” said Sandra Gálvez, 52, a school janitor in Tegucigalpa.

    A supporter of Mr. Hernández’s conservative National Party, Ms. Gálvez added that Mr. Trump’s pardon “proved what we in the party have always said: that the trial against Juan Orlando was a lie concocted by criminals and political enemies.”

    Others strongly disagree. Mr. Hernández’s troubled tenure saw deadly protests erupt over his disputed re-election in 2017 and a surge in migration out of Honduras as people confronted violence and poverty.

    The Sunday Mr. Hernández arrived in Honduras, Father Ovidio Rodríguez, a Catholic priest in Tegucigalpa, went viral after delivering a searing critique of the crowds celebrating the former president’s return during mass.

    “I’m going to say this, and I ask for your forgiveness: the Honduran people are masochists,” Father Rodríguez said, reminding the public not to forget major corruption scandals associated with Mr. Hernández, including the Pandora Case.

    “A masochist,” he said, “is someone who lives happily with pain.”

    What happens now?

    On Monday, Mr. Hernández will appear before a Supreme Court justice for his initial arraignment, at which the judge will decide whether he is detained while the proceedings continue. Because he returned voluntarily, he could potentially remain free.

    An evidentiary hearing is scheduled shortly after. The judge could then send the case toward trial, shelve it or dismiss the charges entirely.

    If the case moves to trial, it won’t end anytime soon. Complicated banking records, shell companies and political finance networks mean that audits and appeals could easily drag the legal battle out for years.

    Yet a strong legal precedent already exists in his favor.

    One of Mr. Hernández’s co-defendants in the Pandora Case is his predecessor, former President Porfirio Lobo — whom the U.S. sanctioned in 2021, alleging he accepted cartel bribes. Honduran prosecutors accused Mr. Lobo, whose term ran from 2010 to 2014, of allowing public funds to be systematically diverted under his watch.

    However, Mr. Lobo won a complete dismissal last month after his defense successfully argued that even if funds were stolen, prosecutors could not prove he had personal knowledge of or ordered the theft. Mr. Hernández’s lawyers, experts say, could employ a similar argument.

    “It wouldn’t be surprising if he walks away cleared of all charges,” said Juan Carlos Aguilar, an anti-corruption lawyer, noting Honduras has never convicted a former president.

    “This case presents a major test for Honduras,” Mr. Aguilar said, “especially for its justice system.”
