A federal judge in California This Tuesday, the ban was extended to the entire United States to the Immigration and Customs Enforcement (ICE) agents to perform immigration court detentionswhich represents a hard blow to the policy of mass deportations of President Donald Trump.
Judge P. Casey Pitts, of the Northern District Court of California, extended nationwide an order given last December that prevents officers from ICE and the Executive Office of Immigration Review (EOIR) of the Department of Justice from waiting in the hallways for immigrants who lose their cases to detain them.

“ICE and EOIR did not provide explanations justified for their actions, the Court concludes that each of the contested policies is arbitrary and capriciousin contravention of the APA (Administrative Procedure Act),” wrote the magistrate appointed by former President Joe Biden (2021-2025).

The ruling also prohibits ICE from holding immigrants in its registration facilities for prolonged periods.
As part of your mass deportation campaignhe Trump Government had brought down since last year the immigration arrest restrictions in the calls ‘sensitive places’such as hospitals, religious centers, schools and immigration courts.
The images of the detentions in immigration courts amid tears and resistance from families and lawyers have generated a wave of criticism against the White House.

Additionally, the tactic caused a drastic drop in court appearances, court records show. In most cases, immigrants receive deportation orders in absentia for failing to attend hearings.

Pitts had issued a ban last December that it only applied to ICE’s jurisdiction in San Francisco (California), a region that covers the entire north and center of the state, due to a emergency decision of the Supreme Court that limited judges from issuing national bans until the collective nature of the demands was considered.

The governor of Florida, Republican Ron DeSantis, criticized the judge’s decision in a message on his X account. “This is another example of biased judges hindering the application of immigration laws.”
It is expected that the Trump government appeals the decision and that the battle even reaches the Supreme Court, dominated by conservative judges.
