KUCHING (April 17): A 19-year-old Indonesian woman was fined RM10,000, in default three months’ imprisonment, by the Magistrates’ Court here for operating an online gambling activity using a mobile phone.
Magistrate Leona Dominic Mojiliu imposed the sentence after the accused pleaded guilty to a charge under Section 4B(a) of the Common Gaming Houses Act 1953.
The offence carries a fine of between RM10,000 and RM100,000 for each gaming machine seized, as well as imprisonment of up to five years upon conviction.
The accused was found to have been operating a gaming machine via a mobile phone at an eatery along Jalan Stutong at about 11.50am on March 11.
According to the facts of the case, police raided the premises following intelligence gathering and found the accused seated in front of the shop counter.
An inspection revealed that she was involved in online gambling activities by selling credit top-ups for gambling purposes through her mobile phone.
An expert later confirmed that the mobile phone had been used as a gaming machine for gambling activities.
Deputy public prosecutor Muhammad Aidil Akmal Sharidan appeared for the prosecution, while the accused was unrepresented.
The accused had previously been sentenced to three months’ imprisonment under Section 6(1)(c) of the Immigration Act 1959/63.
