The appointment formalizes the appointment of Rodríguez Monteza in the Second Supreme Prosecutor’s Office Specialized in Crimes Committed by Public Officials. From this office, the magistrate will have jurisdiction over investigations that involve senior leaders and members of the justice system.
The return establishes a recomposition of the Board of Supreme Prosecutors, by reinstating a member previously dismissed by the National Board of Justice (JNJ). The ruling of the Constitutional Court was based on the violation of due administrative process and the expiration of the sanctioning procedure.
The highest interpreter of the Constitution determined that the disciplinary procedure against the prosecutor had expired before the dismissal sanction was issued. Consequently, the National Board of Justice He reinstated the magistrate’s title on July 7 in compliance with the court order. This administrative step allowed the Attorney General’s Office to proceed with the internal movements necessary for his immediate reinstatement.
Restructuring after the return of Víctor Rodríguez Monteza
The incorporation of Rodríguez Monteza generated structural changes in other high-ranking offices. The titular supreme prosecutor Zoraida Avaloswho headed the position assigned to the magistrate, was transferred to the First Supreme Criminal Prosecutor’s Office. Likewise, the appointment of Gilmer Robinson Jara Vergara as provisional supreme prosecutor was ordered to perform functions in the First Supreme Specialized Prosecutor’s Office.

The original dismissal occurred in November 2021 by unanimous decision of the National Board of Justice. At that time, he was accused of alerting the criminal network about judicially authorized telephone interceptions.
