In Uzbekistan, the law on demolishing old multi-apartment buildings and building new ones is about to be signed. The 80 percent owner consent clause is one of the most controversial aspects of the law. In an interview organized by Kun.uz, the Ministry of Justice clarified that the 80 percent norm is related to another issue; 100 percent must be agreed with the owner before the start of demolition.
Yesterday, the chairman of the Urbanization Committee, Sherzod Gudbiyev, speaking about the renovation process, said that the consent of 80 percent of the owners would be sufficient for this. said. This number is also indicated in the law “On Urban Development Renovation” approved by the Senate.
In an interview organized by Kun.uz on this topic, the representative of the Ministry of Justice clarified this issue. The head of the Department of Economic Legislation of the Ministry, Khidirali Sadikov, said that 80 percent approval is needed only for the renovation proposal to move to the next stage. 100 percent approval of property owners is required for renovation.
“There was a misunderstanding here, that is, 80% is needed only for the proposal to pass, and 100% approval is obtained. If a person is dissatisfied with the demolition of his house, it will not be demolished. There are also opinions about whether the document has been changed in the Senate, after all, this is impossible. The Senate cannot change the bill, it either accepts or rejects it.” he says.
Hidirali Sadikov, talking about the conflict of the 80 percent limit set in the renovation law – the remaining 20 percent of the owners’ property rights, justified this norm with Article 21 of the Constitution. According to this article, a person must not harm the rights, freedoms and legal interests of other persons while exercising his rights (in this case, property rights).
“Let’s say you live in an apartment building that is in a state of disrepair. You can’t just say, ‘No, I live in this house, it’s my property.’ – the justice official explained.
According to representatives of the Urbanization Committee, who participated in the interview, compensation will be paid to the owners of renovated apartments based on the market price.
“Everything has a price, independent property valuation companies work and issue a price. Many homeowners want to negotiate a high price, but international experience should not be forgotten.” says Artyom Kreskas, head of the committee.
Mayor Murodkhan Usmanov emphasized that the renovation should be carried out with a thorough analysis and the load on the engineering networks should be taken into account.
“First of all, it is necessary to analyze and listen to experts. It is necessary not to ignore the engineering aspects of the issue. Demolishing a 3-story building and building a 10-story house in its place does not correspond to the existing engineering networks at all.” he says.
The city planner added that the most important thing is how the renovation will affect the overall image of the city.
