In the first case Indecopi detected, after an alert from Sunat Customs, the importation of toys with these well-known superheroeswhich were immobilized before being put on the market. The importer, a natural person, did not prove that he had a license or authorization to use said protected creations and a fine of 10 UIT was imposed.
In a second case, Another importer entered the country with 851 headphone cases with images of characters such as Spider-Man, Iron Man, Captain America and Venomalso without authorization. These products were seized and a fine of 3.82 UIT was imposed.
In both cases, Indecopi concluded that the products reproduced these characters without permission, affecting the exclusive right of the owner to control the use of his works, even in activities such as importation. It should be noted that the violation is established from the moment the products enter the country, even if they are not sold.
Finally, the entity recalled that copyright protects creators or companies that own these rights, and allows them to decide who can use their works. Therefore, it is not permitted to manufacture, sell or import products with these elements without your authorization, since these are works protected by law.
