A week after the Constitutional Court (CC) agreed to declare admissible the appeals that sought to annul the resolutions that suspended the elections for the rector of the USAC, the plenary session of magistrates signed the resolutions that validate the re-election of Walter Mazariegos.
Sources who prefer not to be cited explain that the presidency of the CC presented files 3901-2026 for signature; 3886-2026; and 3477-2026, of which two are part of the appeals presented by university authorities against the suspension of the rector election.
These files arrived at the CC after two courts provisionally suspended the re-election of the rector, based on complaints of a series of defects in the process held on April 8 in Antigua Guatemala.
One of these protections was confirmed in a ruling and declared the definitive suspension of the election, which raised doubts about the fate of the process of renewal of university authorities.
Files 3901 and 3886 were presented by the Commission of the University Electoral Body, presenting one in response to each of the protections.
But there are also files 4214-2026 and 4289-2026, which the Higher University Council (CSU) presented against the provisional protections, detailed a source close to the Usac administration.
The opposition group Usac Dignidad y Resistencia (USAC-DIRE) assures that the appeals filed against the process, in courts, appeals chambers and the CC, could not argue that the previous phases were not exhausted.
All due to a series of modifications to the regulations that the CSU changed, eliminating procedures that, in the opinion of USAC-DIRE, make the only possible means to challenge are amparos.
Until now, the opposition or the USAC authorities have not been notified of the latest decisions of the CC.
