The reaction of the Judicial Council is almost no different from the reaction of a primitive-political mafia lawyer, Boris Bogdanović, president of the Club of Deputies of Democratic Montenegro, announced this evening.
He reacted to today’s announcement by the Judicial Council, which states, among other things, that Bogdanović’s accusations against the judge of the Basic Court in Podgorica are inappropriate and unfounded.
“Gentlemen from the Judicial Council, do not try to replace theses. The point is not which judge handed over the case to another judge due to the death of his father. The point is that the persons suspected of providing logistics for Miloš Medenica’s escape from that judge were released from prison to defend themselves. The point is that the state is fighting organized crime, and that part of the judiciary is making the fight meaningless with its decisions. We express human respect for every death in the family and we do not allow anyone to personal pain drags into political controversy. But we will not allow that circumstance to be used as a smoke screen to avoid the key question, why were persons suspected of providing logistics for the escape of a man whose image is being used by criminal structures to discredit the state?” emphasized Bogdabović in a statement.
He added that the Judicial Council was more concerned about the criticism of deputies than the fact that in cases concerning organized crime, logistical networks, escapes and compromised power centers, decisions are repeated that destroy citizens’ trust in justice.
“I ask you publicly, what did you do when the Police Administration delivered over 300 notices to the courts about violations of surveillance measures? Did you then ask yourself whether the system is working? What did you do when suspects leave the prison cells because of failure to deliver judgments, and then commit new murders? Did you ask yourself how it is possible that judges in such circumstances receive the highest marks? official Slavoljub Šćekić? How many more criminals will be released from custody by the end of the year if this efficiency continues, while the deadlines are approaching, and trials are taking place?”, said Bogdanović.
He told the Judicial Council that it is not a problem that the judiciary must be independent.
“The problem is when independence turns into untouchability, independence into arbitrariness, and the absence of political influence into the absence of any responsibility. Did Vesna Medenica leave you a trust of independence or a trust of a closed system in which no one is accountable to anyone? You have practically confirmed what the public already knows: the judge you mentioned earlier acquitted Veselin Veljović in the case of the attack on police officers during the enthronement of Metropolitan Joaniki. The same judge also acquitted him in the case “Tunel”, so one of the persons from that case ended up under suspicion for helping in the double murder in Cetinje. If that is not a reason for concern for the citizens of Montenegro, then answer the citizens. Is it normal that the state arrests, the prosecution initiates proceedings, and then everything stops in front of a wall of judicial inefficiency and institutional silence?
According to him, it is particularly scandalous that in this case it is not only about release, but about the decision canceling the prosecutor’s detention of 72 hours, which, as Bogdanović said, does not happen often.
“And instead of worrying about it, you attack those who demand responsibility. And it is completely irrelevant whether the decision was made by the judge who closed the case or the judge to whom the case was handed over due to a death in the family, what matters is how and why it was decided this way? And one more thing: when the president of the High Court, Zoran Radović, publicly says that the director of the police should not interpret the law, it is not an ethical problem for you. But in a very similar case, you dismissed the president of the Court of Appeal, Mirjana Popović. Citizens have the right to ask: do the rules apply to everyone, or only to those who are not part of the judicial-political circle close to the old centers of power and Vesna Medenica?”, said Bogdanović in a statement.
He said that the Judicial Council must not be a law office of a closed judicial circle.
“He must protect the honorable judges, of whom there are many, and not create a shield for those for whom the honorable judges bear the burden of public distrust. Montenegro does not need a judiciary that gets angry at questions. Montenegro needs a judiciary that gives answers. Because justice that is ten years late is not justice. Justice that remains silent in the face of crime is not independent. a primitive political lawyer of the mafia,” said Bogdanović.
