This coming April 30th the Law 98-25 in the Dominican Republic, which modifies the Law 225-20 of Comprehensive Management of Solid Waste with a broad rejection manifested in the commercial sector, who describe as “abusive” the payment that the norm establishes while demanding an urgent modification of it.
On previous occasions they explained that their disagreement originates from the fact that article 36 of the aforementioned norm increases the special contribution of companiesespecially to MSMEs, based on annual income.
Willing to look for an alternative to analyze the contribution rate, business leaders held a meeting at the National Congress with the presidents of the Senate, Ricardo de los Santosand of the Chamber of DeputiesAlfredo Pacheco. In addition, they met with the Minister of Industry, Commerce and MSMEs, Eduardo Sanz Lovatónand the general director of Internal TaxesPedro Urrutia.
According to statements by the minister, the meeting arises as a conciliation process between the different sectors involved, to reach a definitive solution to the issue, but at the same time the legislative norm is applied.
“We are making an effort to reconcile the details in the application of the solid waste law,” the official said.
So far, the result of this closed-door session, according to a statement from the president of the Dominican Federation of MerchantsIván García, was to reconcile with the DGII proceed with the statements of the fiscal year 2025, allowing that, even when payment authorizations for solid waste are generated, the value generated will not be paid on April 30.
The document explains that the measure will be taken while Congress approves the modification of the rates, where the taxes generated with the sworn declaration From 2025, IR-2, 1% of productive assets and advances have to be paid normally.
“The General Directorate of Internal Taxes is going to proceed in the system so that surcharges are not generated,” can be read in the letter.
It is also added that for those who paid RD$675 thousand pesos or the value of Law 98-25, the value resulting from the new rate of the modification of the law and the amount paid will be credited.
The manifesto concludes with the recommendation that, to avoid congestion at the end of the month on the platform at the collecting institution, the process of submitting the 2025 affidavits begins this Friday.
