
The National Superintendency of Public Records (Sunarp) confirmed the ownership of the Municipality of Miraflores on the property of Municipal Market No. 1. This decision rejects the attempt by the Surquillo commune to register the supply center in its name, after determining that said claim has no legal basis.

The resolution of the competent authority establishes that the property is duly registered in the name of the Miraflores edile corporation in the registration item No. 07017698. Likewise, the agency pointed out that the arguments presented by Surquillo were based on erroneous interpretations of current regulations.

In its statement, Sunarp warned that the request from the Surquillo authorities suffers from a “insurmountable defect”which confirms its absolute inadmissibility. The entity specified that the law creating Surquillo defines territorial limits, but does not transfer ownership of properties that belong to Miraflores.
Lino de la Barrera, manager of the Legal Department of Miraflores, stated that the ruling recognizes that the commercial space was correctly registered in the public records. For its part, the Miraflores municipality urged the authorities of the neighboring district to respect the legal framework and avoid promoting unfounded controversies.

This dispute has legal precedents, such as the ruling of Constitutional Court of the year 2008. In that process, it was determined that Surquillo has the competence for the administration and management of the services because it is in its jurisdiction, but the registered property right of Miraflores was left safe.
Currently, Market No. 1 has been closed since August 2024 due to structural and security deficiencies. The Surquillo administration has announced a comprehensive remodeling plan and plans to reopen the supply center for May 2026.
