The bill that modifies Law No. 45/91 has the support of the government after adjustments in the legislative technique. Senator Eduardo Nakayama pointed out that the intention is to streamline and reduce costs when the separation is by mutual agreement.
The so-called “Express Divorce” is a bill currently under discussion in the Congress of Paraguay that seeks to modify article 5 of Law No. 45/91. Its main objective is simplify, cheaper and accelerate the process divorce by mutual consent.
Eduardo Nakayama, one of the senators who supported the proposal of this law, indicated that with the legislative modifications The ruling party would agree.
“Actually It’s not just cutting deadlinesbut also simplify the process. We know that today the intervention of professional lawyers is required to be able to carry it forward and from now on, with this bill, that will be dispensed with when there is mutual consent,” explained the legislator.
He then added: “That It has already been approved with modifications this morning in the Legislation Commission and with that I would have the support of the other colleagues so that the legislative session can be approved tomorrow.”

When asked about the corrections that were made, he indicated that They were technical corrections of legislative technique. “There were several things that we had to tweak from the original project, which was planned because I don’t know why it wasn’t sent to the Legislation Commission at the time. Yes to Children and Adolescents, also to the Equity and Gender Commission.”

Finally, the senator maintained that many people separate, but do not legally divorce because the barrier they always encounter is economic. “No one is going to work for you for less than 3.4 million. In fact, the average is between 4 and 8 million, which is what a divorce costs today.”
