The way back to prison was taken by Alexandros Yiotopoulosas the Criminal Department of the Supreme Court decided to overturn the decision of the Piraeus Appeals Council that showed him to be released from prison.
In the afternoon, outside his place of residence a large police force had gathered while its leader November 17 boarded a taxi, accompanied by two Police patrol cars. Afterwards, he transferred to an OPKE vehicle.
Late in the afternoon it was finally decided that he will be detained today in GADA and tomorrow he will be presented to the Piraeus Appeals Prosecutor.

Although Yiotopoulos, who was sentenced to 17 life sentences and an additional 25 years in prison, had passed the prison exit gate two weeks ago, the deputy prosecutor of the Supreme Court, Sofocles Logothetis, who studied the case file, recommended an appeal against the council, expressing the opinion that in Yiotopoulos’ case the legal conditions for conditional release are not met.
At the heart of the prosecutor’s argument was the assessment that the case of Yiotopoulos falls within the law 4855/2021, which states, among other things, that “the convicted if he serves more life sentences can be released if he has remained twenty-five (25) years”, and not the previous law that wanted an actual sentence of 19 years, on which the Piraeus Appeals Council was based.
What does undo mean?
The annulment of the will means that the will of the Piraeus Appeals Council “disappears” and revives the will of the Misdemeanor Council that had denied Yiotopoulos release from prison.
The issue will be re-examined by the Appeals Council of Piraeus with a different composition.
Of course, the Piraeus Appeals Council can no longer follow a different path than the one that the Supreme Court will draw, as in the same law (4855/2021) there was an amendment to article 524 of the CPC and the addition of a third paragraph, which states that “the decisions of the Plenary and the divisions of the Supreme Court bind the courts dealing with the same case, in terms of the legal issues they resolved”.
