MIRI (April 17): A 37-year-old man was sentenced to 12 months’ imprisonment by the Magistrates’ Court here after pleading guilty to assaulting his wife by punching her in the face.
Magistrate Ashok Linggam handed down the sentence to Jay Kishen Jame Wan, who was charged under Section 323 of the Penal Code, read together with Section 326A of the same Code.
Section 323 provides for imprisonment of up to one year, or a fine of up to RM2,000, or both, while Section 326A allows for up to twice the maximum imprisonment term for offences involving a spouse.

After considering the accused’s guilty plea, the facts of the case, the seriousness of the offence and public interest, the court sentenced him to 12 months in prison, effective from the date of arrest.
During the proceedings, the court was also informed that the accused had previously been sentenced to 24 months’ imprisonment on June 17, 2020 for a similar offence involving the assault of his wife with a soy sauce bottle.
Deputy public prosecutor Mohammad Syafiq Samry appeared for the prosecution, while the accused was unrepresented.
