According to the facts of the case, the accused was arrested at about 3pm on April 6 in a room at Kampung Mulung, Long Lama, Baram, during an inspection after police suspected that he was a foreign national.
MIRI (April 17): An Indonesian man was sentenced to six months’ imprisonment and one stroke of the cane by the Sessions Court here after pleading guilty to entering the country illegally.
The court also ordered that the accused be referred to the Immigration Department for deportation upon completion of his sentence.
Dan Dan Surya Ramdani, from West Java, Indonesia, was charged under Section 6(1) of the Immigration Act 1959/63 and punished under Section 6(3) of the same Act.
The offence carries a fine of up to RM10,000, imprisonment of up to five years, or both, and may also include whipping of up to six strokes upon conviction.
According to the facts of the case, the accused was arrested at about 3pm on April 6 in a room at Kampung Mulung, Long Lama, Baram, during an inspection after police suspected that he was a foreign national.
During initial questioning, he failed to produce any valid travel documents allowing him to enter and remain in the country.
He was subsequently arrested and taken to the police station for further action.
Deputy public prosecutor Mohammad Syafiq Samry appeared for the prosecution before Judge Afidah Abdul Rahman, while the accused was unrepresented.
