The Investigative Unit of EL TIEMPO has been revealing for the first time the corporate dispute between the heirs of the business conglomerate, present in more than 7 countries and considered the fourth largest in Colombia. The case has become relevant because the Prosecutor’s Office is investigating a disbursement from Ecopetrol -revealed by the Investigative Unit of EL TIEMPO- to one of the Vélez firms for the transfer of the Termorichal I and II energy generating plants. 42 million dollars were paid despite old concepts that indicated that the transfer was at zero cost.
In the midst of these investigations, this newspaper learned of lawsuits, complaints, arbitration courts and even a guardianship filed by the lawyers of one of the heirs, Lina María Vélez Gaviria, against her sister, Sandra María Vélez Mesa.
Lina Vélez asks for the protection of her rights and those of her children and for the plan of economic violence that, according to her, has been unleashed against her by her sister and other administrators and controllers of the business emporium to cease.
Sources from the Constitutional Court confirmed to EL TIEMPO that, despite the fact that the constitutional action was denied in two instances – after the response by Jaime Lombana, Sandra Vélez’s lawyer, was selected for study by courtroom 9 of guardianships, composed of judges Carlos Camargo and Jorge Ibáñez, under the heading of violence against women.

But there was another episode that same day that just fueled the corporate fight.
Indeed, The Investigative Unit of EL TIEMPO established that a man who was captured in Medellín for extradition purposes, the same day that the Court selected guardianship of the case, is the biological father of Lina Vélez’s husband.
The CTI of the Prosecutor’s Office, the military Gaula and the US Marshals Agency made effective a request for the arrest of the Peruvian justice system for the drug trafficking crime of Juan Carlos Posada Orozco.
The concern that aroused is that her two children – including Juan Felipe Posada Rojas, Lina’s husband -, and his mother (María Eugenia Rojas Díaz), appear in the Grupo Colviva Sas. This, in turn, is a shareholder in the Penderisco I SAS, ESP Hydroelectric Power Plant, which also includes Intraseo – one of the flagships of the Vélez emporium -, Gen+ SA and Inversiones Borealis SAS.

The Investigative Unit of EL TIEMPO contacted Jaime Granados, head of the defense of Lina Vélez together with the firm Brigard and Urrutia, and began by ensuring that the names and information of the captured person, as reported by the press, in fact correspond to those of the biological father of Juan Felipe Posada Rojas.
But he made some background clarity: “For more than 25 years they have not had any contact, neither personal nor economic. He abandoned them when my client was 10 years old and they consider him like a deceased father. He does not even know Lina Vélez or her children.”
And he added: “It seems vile to me that any fellow lawyer would use this to muddy a process in which the authorities will be the ones to define who is right. This lacks professional height and results in anti-law conduct.”
Through his representatives, Juan Felipe Posada sent his statement to EL TIEMPO: “My parents separated more than 30 years ago. Since then, my mother assumed the economic and emotional responsibility for my siblings as head of the household. and me, ensuring our well-being and accompanying us during our personal and professional training.

And he added: “For more than 15 years I have not maintained a personal, family or any other relationship with my biological father. During this time, he has not been part of the fundamental moments of my life, including my marriage, the birth of my children and his family life. Likewise, my wife and my children do not have and have not had any relationship with him.”
Juan Felipe Posada concluded by assuring: “Any action, statement, circumstance or situation related to my biological father is completely foreign to me, my wife and my children, and should not be understood, under any circumstances, as linked to our family unit.”

THE TIME He also asked him about the complaint that – through Jaime Lombana, Sandra Vélez’s lawyer – was filed by an executive identified as Álvaro Panesso Lineros against the brothers Carlos and Juan Felipe Posada Rojas.
Panesso, legal representative of the firm Goldstone Holding SAS., requests that the brothers be investigated for unfair administration, procedural fraud and falsification of a private document. What is sought to be established is whether an extraordinary meeting of shareholders of the company Central Hidroeléctrica Zeus SAS., ESP, was held to advance a statutory reform, ceding control without compensation. That episode is linked to the fight between William Vélez’s heirs.
Then, Granados is Juan Felipe Posada’s attorney and has already denounced Panesso for ideological falsehood in a private document, aggravated disloyal administration, illegal constraint and disturbance of possession.
