The investigation is led by prosecutor Fernando Ayala Borja, from the Second Office of the Provincial Corporate Criminal Prosecutor’s Office of Huaura, who during the public hearing stated that the incident would have occurred on Mercedes Indacochea Avenue, during a control operation carried out by members of the Emergency Squad on a motorcycle taxi driver who tried to evade the checkpoint, in which the mother, the minor and one other companion were traveling.
According to the investigations, the driver of the vehicle tried to evade the police checkpoint, which caused the motorcycle taxi to get confused and overturn a few meters from an educational institution in the area. Given this, police officers and security personnel proceeded to subdue the driver, who was resisting arrest.
According to the reconstruction of the events contained in the tax file, it was in the middle of the struggle to immobilize the driver when non-commissioned officer Luis Nazario Chumbes used his service weapon. The bullet hit the child directly in the skull.
The minor’s mother questioned the use of the weapon and assured that it was not necessary. “I want justice, I have seen him (the police officer) with the gun at all times; there was no need to shoot. There were 4 officers, or 5 officers; there was peace, there they took him to the driver, they had him on the ground stepping on him, kicking him,” he declared.

After being hit by a bullet, the child suffered a serious traumatic brain injury. Due to the severity of his condition, his emergency medical evacuation was coordinated to a specialized health facility in Lima; However, the procedures and authorizations to complete the transfer from Huacho to the capital took about seven hours, a period after which his death was confirmed.
In parallel with the criminal process faced by the non-commissioned officer, the General Inspectorate of the Police maintains an administrative disciplinary procedure open against Nazario Chumbes to determine institutional responsibilities.
