“Summary” (AKIpress) – On June 25, 2026, the Alamedin District Court of the Chui Region passed a verdict against State Border Service employee Ilyas (name changed, I.T.M.). He found himself in the dock for illegally processing the departure of a Chinese citizen through the Ak-Zhol-Avtodorozhny checkpoint on the border with Kazakhstan.
As stated in the case materials, the accused worked as a senior inspector of the second shift of the Ak-Zhol checkpoint. The man is married, has a secondary education, and has no previous convictions.
What is he accused of?
According to investigators, in 2025, Chinese citizen B.F. arrived at the Ak-Zhol-Avtodorozhny checkpoint from Kazakhstan to enter Kyrgyzstan. During the document check, border guards determined that the foreigner did not have the required entry visa. For this reason, he was refused to cross the state border.
Then the Chinese decided to enter Kyrgyzstan illegally. So, while on the territory of the border checkpoint, he discovered a gap in the metal fence. Using it, the foreigner secretly passed through the fence and, bypassing the established route and border control procedure, ended up in Kyrgyzstan.
A criminal case was opened against the Chinese under Article 378 Part 1 (“Illegal crossing of the State Border of the Kyrgyz Republic”) of the Criminal Code of the Kyrgyz Republic, but this will happen after Ilyas is detained.
After some time, the Chinese citizen decided to legalize his stay in Kyrgyzstan. To do this, he, accompanied by two people, arrived at the Ak-Zhol checkpoint. His entourage, in order, approached the office cabin of the senior controller Ilyas and handed him a passport of a Chinese citizen.
According to the current border control rules, when checking documents, the officer is obliged to establish the legality of a person’s stay in the country. In particular, border guards must check information about the last two crossings of the state border in the Unified External Migration Registration System, as well as the presence of the necessary marks, signatures and seals in the passport.
In addition, the rules prohibit affixing border stamps to the documents of persons who have not actually crossed the border or have not undergone border controls required by law.
However, as the investigation established, Ilyas knew that the Chinese entered Kyrgyzstan illegally and his passport did not have a mark on legal entry. Despite this, the senior controller violated the established procedure.
While on the territory of the Ak-Zhol checkpoint, at approximately 13:06, he used his account in the automated border control system and illegally processed the departure of a Chinese citizen to Kazakhstan. Thus, a foreigner who had previously entered Kyrgyzstan through a gap in the metal fence was able to freely leave the country through the official checkpoint.
This fact was registered under Article 393, Part 1 “Violation of the rules of performing border service”) of the Criminal Code of the Kyrgyz Republic.
What does the accused say?
Ilyas admitted his guilt completely. Also during the investigation, he entered into a plea agreement with the senior prosecutor of the General Prosecutor’s Office
He explained that the plea agreement was concluded on his initiative after consultations with lawyers. Ilyas confirmed that he is aware of the consequences of his decision and does not dispute the charges brought and the evidence collected in the case.
The state prosecutor informed the court that the parties had reached agreement on all the terms of the agreement, and asked to consider the criminal case without holding a trial in the usual manner.
What’s the result?
The court found Ilyas guilty under Article 393, Part 1 “Violation of the rules for performing border service”) of the Criminal Code of the Kyrgyz Republic and sentenced him to pay a fine of 20 thousand soms.
