    Prisoners could request early release in more cases of serious or sexual crimes if the reform of the penal system is approved


    The director of the National Rehabilitation Institute (INR), Ana Juancherecognized that, if the reform of the Code of Criminal Procedure is approved (CPP) that the government sent to Parliament, some two thousand prisoners more could request early release before Justice.

    These are inmates who are imprisoned today for different crimes for which the Urgent Consideration Law (LUC), approved in the last government of Luis Lacalle Pou, took away that benefit. It is about cases of: rape, sexual abuse, especially aggravated sexual abuse, violent indecent assault, sexual abuse without body contact, kidnapping, aggravated homicide, robbery, robbery with deprivation of liberty and extortion.

    In an interview with Five Senses of Channel 5, Juanche pointed out that the reform of the CPP “expands” the list of crimes for which a person can request early releaseestablishing a panorama similar to that which existed years ago, prior to the approval of the LUC.

    But the prison director insisted that the early release “is not an institution that the INR decides”, since granting it or not is a matter of Justice and is evaluated “case by case.”

    “The judge has the power, after the technical reports provided by the CPP and that the INR must prepare, to resolve together with the Prosecutor’s Office, of course. If the Prosecutor’s Office does not object, it (may) grant early release or not.“, argument.

    Juanche assured that it constitutes a “benefit” and a “right” of people deprived of liberty, which with the LUC had been “limited to a smaller set of crimes.”

    The CPP reform bill establishes from article 298 onwards In what cases a person can request early release and what conditions must be met.

    It defines early release as a “right that may be granted to prisoners who are deprived of liberty, when taking into account their conduct, personality, manner and living conditions, a favorable prognosis for social reintegration can be formulated.”

    Furthermore, it highlights that these people will be subject to the “authority surveillance“for the balance of the sentence they have pending.

    The LUC expanded the crimes for which early release cannot be requested. Today, this regime is inapplicable to crimes such as: rape, sexual abuse, especially aggravated sexual abuse, violent indecent assault, sexual abuse without body contact, kidnapping, aggravated homicide, robbery with deprivation of liberty, taking and extortion.

    The CPP reform sent by the Executive, meanwhile, proposes including these crimes again in the possibility of requesting early release, although as long as the person has served “three quarters of the sentence imposed.”

    Opposition criticism

    The changes regarding early release included in the CPP reform have been the subject of criticism from opposition leaders.

    One of them was the Colorado senator, Pedro Bordaberrywho questioned the Minister of the Interior, Carlos Negro, last week and tried to consult him on this issue.
