The initiative, it was indicated, represents “an advanced legal framework” by harmonizing said federal law with state laws.

The minutes, proposed by the President of the Republic, Claudia Sheinbaumreforms article 73, twenty-first section, section A, of the Political Constitution of the country in the area of feminicide.

The Sixty-ninth Legislature in the Congress of Chiapas emphasized that the reform was approved in response to the policies “of the humanism“and with full respect for the human rights.

During the session, headed by the president of the Board of Directors Alejandra Gomez Mendoza(Morena), legislators from different parties validated the constitutional reform project.

Under the statement: “We want each other alive”the deputies emphasized the importance of the approval of the initiative, and highlighted that the Congress of Chiapas was the third in the country, “which proposes an advanced legal framework by homologating said law.”

They argued that the substance of the initiative considers feminicide not as a isolated crimebut as an external expression “of a continuous spectrum of gender violence”, rooted in historical inequalities between women and men.

By standardizing the crime, they stated, with state laws, it avoids fragmentation and lack of coherence that exists between the federal entities regarding the type of crime, its aggravating factors and its sanctions.

Furthermore, it is not just about decentralizing, but about establishing “a minimum floor of protection” in the country, so that there is a homogeneous definition of the crime.

That there are also clear and precise criteria to investigate the crime, that the protection measures and sanctions do not depend on the state in which a woman lives, “because no woman should have more or less protection depending on the state in which she lives.”

The Chiapas legislators stressed that with the aforementioned reform the crime will not end, but in practice it represents an important step towards its homologation, which will allow the strengthening of actions between the three levels of government regarding violence against women.
