The Court of Appeal in Pristina overturned the decision of the primary court by which Šaćir Lutvija was sentenced to ten years in prison for an alleged war crime and sent the case back for a retrial, acting on the appeal of the defense, and due to, as stated, significant violations of the provisions of the criminal procedure, violation of the criminal law, incorrect and incomplete determination of the factual situation and the decision on criminal sanction.
