Setback for Giertych in the “Two Towers” Case. Prosecutors Reject His Motion

“After reviewing the case materials, the District Prosecutor in Warsaw did not grant the motion filed on June 10, 2026, by the injured party’s legal representative, attorney Roman Giertych, seeking the removal of the prosecutor handling the so-called ‘Two Towers’ case,” the Warsaw District Prosecutor’s Office announced.

The investigation into the “Two Towers” case, in which Austrian businessman Gerald Birgfellner is considered the alleged injured party and is represented by attorneys Roman Giertych and Jacek Dubois, was launched by the Warsaw District Prosecutor’s Office in February of last year. Previously, in 2019, the same prosecutor’s office had refused to initiate an investigation into the matter.

On Wednesday, Jarosław Kaczyński, leader of the Law and Justice (PiS) party, was questioned at the Warsaw District Prosecutor’s Office. The hearing lasted nine hours, beginning at 10:00 a.m. Giertych had earlier made bold announcements about the questioning on the X platform. However, he did not remain until the end of the proceedings. Later, he complained that the prosecutor had dismissed 80 percent of his questions and announced that he would seek her removal from the case.

As previously reported by Niezalezna.pl, Giertych allegedly asked questions unrelated to the subject of the investigation, which is why most of them were disallowed.

On Monday, the Warsaw District Prosecutor’s Office announced its decision regarding the Civic Coalition (KO) politician’s motion.

The so-called “Two Towers” affair originated from reports published by the newspaper Gazeta Wyborcza in January 2019. The articles described negotiations between PiS chairman Jarosław Kaczyński and Austrian businessman Gerald Birgfellner concerning the construction of two office towers on land owned by the Warsaw-based company Srebrna. The project, however, was never completed.
