The operation of the Honduran electricity market will enter a new stage if the National Congress approves the reform project to the Framework Law of the Electrical Subsector that the Government plans to send for discussion.
The proposal contemplates, specifically in its article 9, the creation of the System and Market Operator (OSM), a technical and independent body that would be in charge of the administration of the National Interconnected System (SIN).
The OSM will replace the National Dispatch Center (CND), created by Decree 046-2022 (Special Law to Guarantee the Electric Energy Service as a Public Good of National Security and a Human Right of an Economic and Social Nature).
Alejandro Dumas, government advisor on electrical issues, maintains that the CND is a department attached to Enee and manages all transactions, however, it should be a transparent and independent entity.
He adds that the CND should ensure the security of the system and all the agents that participate in the national electricity market; Enee is just another agent and in a modern system it cannot have control over the market.
Karla Martínez, president of the Honduran Association of Electrical Energy Producers (Ahpee), maintains that in countries with competitive electricity markets, the system works with a technical and independent operator, which manages under principles of transparency and objectivity, which ensures users and the legal security of all system participants.
The OSM will guarantee the continuity and security of the electricity supply, the correct coordination of regional generation, storage, transmission and exchange systems at the minimum cost for all electricity market operations.
The OSM will not be part of the public administration and will be headed by a board of directors, made up of three directors chosen through a competition led by a nominations committee.
The term of the directors will be six years, and they may be re-elected once.
