The company Izvorna celica and the Polish Institute for Tissues and Cells PBKM are s headquarters of Gaia Cellwhich stores samples of the failed Biobank, downloaded samples on fridayfor which the holders have concluded contracts on further storage with Izvorna celica. The Public Agency of the Republic of Slovenia for Medicines and Medical Devices (JAZMP) is against the director of Gaia Cella Gordani Kalan Živčec due to obstruction of transmission filed a criminal complaint.
In addition, they asked the police for help on Monday and Tuesday. Despite the fact that Gaia Cell provided access to cryovials and documentation, according to the agency, it hindered the execution of the decision by which the JAZMP ordered Gaia Cell to hand over all stored human tissue and cell samples and related Biobank documentation to the relevant tissue and cell institutions.
One of the facilities that several hundred sample holders wanted to transfer you to is the Source Cell. She transferred the samples to Poland last week to the PBKM laboratory, which is the founder of the Fami Cord group, an international group of cord blood banks. They did this under the supervision of JAZMP inspectors and with the cooperation of Biobanka’s bankruptcy administrator, the agency also announced.
Due to the non-cooperation of the Gaia Cell company, the Agency issued a decision on the enforcement of the decision, in which it was written that they allow the enforcement in such a way that the company Izvorna celica only searches for the samples and the related documentation, checks the adequacy of the data and moves the samples to its cryogenic container. Before that, Gaia Cell did not want to hand over the samples to Izvorna cella, as it insisted that Izvorna cella had to pay it first, even though Gaia Cell took about 4,000 samples from the bankrupt Biobank in 2024 without any legal basis.
Nerve Kalanova responded
Director Kalan Živčec is in favor STA asserted that they were forced to work overtime due to poor work organization. Samples were transported for more than 12 hours, including without the right to rest. This is also why the director turned to the labor inspection, and JAZMP reported it to the National Investigation Office. She reiterated that the agency already ran over all our constitutional and legal rights with its decision.
She also emphasized that the samples were taken from the premises of Medico Veritas, which is another, separate legal entity. It is another company, Kalan Živčec, which is based at the same address as GaiaCell.
Since then, JAZMP has repeatedly asked the owners of the samples to make arrangements with selected companies, including Izvorna celica, for the transfer, further storage or destruction of the samples. Due to the non-cooperation of Gaia Cell, the Agency issued a decision on the enforcement of the decision, in which they wrote that they allow the enforcement in such a way that the company Izvorna celica only searches for the samples and the related documentation, checks the adequacy of the data and moves the samples to its cryo container.
At the same time, they stated that forced entry into business premises, where there are cryovials with stored samples of human tissues and cells stored by the Biobank, is allowed. JAZMP wrote in the explanation of the decision that this is the only possible way to enforce the decision at all, and they referred to the Act on Administrative Procedure.
